Opposite parties\n\n                             ------------\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>      Heard Counsel for the petitioner and the Standing Counsel on<br \/>\nbehalf of the respondents.\n<\/p>\n<p>      Counsel for the petitioner submits that the petitioner in the<br \/>\ninstant writ petition has sought quashing of the charge sheet inter-<br \/>\nalia on the ground that the petitioner at the relevant time was<br \/>\nworking as Seasonal Naib Tehsildar [Collection] Gorakhpur and as<br \/>\nsuch the charge-sheet should have been approved by the Appointing<br \/>\nAuthority but without any approval from the appointing authority,the<br \/>\nSub Divisional Magistrate, Sadar issued the charge sheet. Therefore,<br \/>\nthe entire disciplinary proceedings are non est and deserves to be<br \/>\nquashed. Apart from above, various other arguments were advanced<br \/>\nto show that the disciplinary proceedings were per se bad as no<br \/>\ndate, time and place of enquiry was fixed, the petitioner was not<br \/>\ngiven adequate opportunity to defend himself.\n<\/p>\n<p>      On behalf of the respondents, Standing Counsel has stated<br \/>\nthat before appointment of the deceased petitioner,he worked as<br \/>\nCollection Amin. As the appointing authority of the post of the<br \/>\nCollection Amin was the District Magistrate and the charges for<br \/>\nwhich disciplinary proceeding was initiated,    were related for the<br \/>\nperiod   when the deceased petitioner was Collection Amin and as<br \/>\nsuch the charge sheet dated 17.9.1993 was issued. Thereafter, due<br \/>\nprocedure was followed and even the Board of Revenue after<br \/>\nscrutinizing the material on record, came to the conclusion that the<br \/>\ncharges levelled against the deceased petitioner are proved.<br \/>\nConsequently, punishment order was passed.\n<\/p>\n<p>      The State Government has framed The Subordinate Revenue<br \/>\nExecutive Service ( Naib-Tehsildars ) Rules, 1944 for regulating the<br \/>\n<span class=\"hidden_text\">                                                                      2<\/span><\/p>\n<p>appointment to posts in the Subordinate Revenue Executive Service<br \/>\n( Naib-Tehsildars) and the conditions of services of persons so<br \/>\nappointed. Rule 2 deals with the Status of the service and says that<br \/>\nthe Subordinate Revenue Executive Service ( Naib Tehsidlars) is a<br \/>\nsubordinate service and shall be under the administrative control of<br \/>\nthe Board. Rule 22 deals with the appointment and provides that the<br \/>\nBoard shall, on the occurrence of substantive vacancies in the<br \/>\nservice make appointments thereto, in order of seniority of<br \/>\ncandidates, whose names are entered in the list maintained under<br \/>\nrule 20.\n<\/p>\n<p>      From the perusal of the records it clearly comes out that the<br \/>\ncharge sheet and the supplementary charge sheet were issued by<br \/>\nthe Collector. The    Inquiry Officer was also appointed by the<br \/>\nCollector. It is not disputed by the parties that the deceased-<br \/>\npetitioner was working on the promotional post of Naib Tehsildar<br \/>\nwhen the charge sheet was issued. Infact the deceased-petitioner<br \/>\nwas promoted to the post of Naib Tehsildar in the month of January,<br \/>\n1983. Undoubtedly, the Appointing Authority of the deceased-<br \/>\npetitioner was the Board of Revenue. Therefore, the Collector was<br \/>\nneither competent nor empowered to issue charge sheet to the<br \/>\ndeceased-petitioner. Further, he was also not competent to initiate<br \/>\nthe enquiry against the deceased-petitioner. Since I am satisfied that<br \/>\nthe charge sheet was issued by the incompetent authority the<br \/>\nconsequential disciplinary proceedings and punishment order are per<br \/>\nse bad and are not sustainable, I refrain myself from entering into<br \/>\nother arguments advanced by the parties Counsel.\n<\/p>\n<p>      In view of the above, the writ petition is allowed. The charge-<br \/>\nsheets contained in Annexures 1 and 2 and the consequential show<br \/>\ncause notice and punishment order are hereby quashed.
