Justice M.L.JOSEPH FRANCIS\n\n Dated :20\/12\/2010\n\n O R D E R\n                 A.K.BASHEER,J &amp; M.L.JOSEPH FRANCIS, J\n               -------------------------------------------------------------------\n                                MACA.NO.228 OF 2009\n                            ----------------------------------------\n                    Dated this the 20th day of December, 2010\n\n\n                                        JUDGMENT\n<\/pre>\n<p>      The appellant contended before the Motor Accidents Claims Tribunal<\/p>\n<p>that he suffered the following injuries in a road traffic accident that occurred on<\/p>\n<p>December 4, 2004:\n<\/p>\n<blockquote><p>      Laceration of ( R ) heel with pad avulsion<\/p>\n<p>      Fracture neck of fibula ( R )<\/p>\n<p>      Fracture lateral malleolus ( R )<\/p>\n<p>      According to the appellant, he under went treatment, initially in Indo<\/p>\n<p>American Brain and Spine Centre, Chemmanakary and later in Specialist<\/p>\n<p>Hospital, Ernakulam following necrosis of heel pad.<\/p><\/blockquote>\n<p>        Ext.A13 certificate issued by the Asst. Professor, Orthopeadics in the<\/p>\n<p>Medical College Hospital, Kottayam revealed that the appellant had the<\/p>\n<p>following problems:\n<\/p>\n<blockquote><p>      Gross scarring ( R ) heel, with sensory deficit<\/p>\n<p>      Inability to walk on bare foot<\/p>\n<p>      Tenderness (L) heel, shortening 2 cm (R ) lower limb<\/p>\n<p>      Restriction of movements<\/p>\n<p>      (R ) ankle From plangrade position no dorsi flexion possible, 25<\/p>\n<p>degree plantar flexion possible.\n<\/p><\/blockquote>\n<blockquote><p>      X-ray (R ) ankle and leg: Moderate soft tissue swelling present<\/p>\n<p>      Moderate joint space narrowing<\/p>\n<p>      Union of fracture lateral malleolus with 5 degree medial<\/p>\n<p><span class=\"hidden_text\">MACA.NO.228 OF 2009                      2<\/span><\/p>\n<p>       angulation, neck of fibula with 5 degree medial angulation.<\/p><\/blockquote>\n<p>       The doctor certified that the appellant has got a permanent partial<\/p>\n<p>functional disability of 12% based on the above &#8220;clinico radiological findings<\/p>\n<p>and according to Mc Bride Scale, taking the body as a whole&#8221;. Though<\/p>\n<p>Ext.A13 certificate was available before the Tribunal, no compensation was<\/p>\n<p>awarded under the head of permanent partial disability. Learned counsel<\/p>\n<p>submits that the Tribunal was not at all justified in ignoring Ext.A13 totally.<\/p>\n<p>There is considerable force in the above contention.<\/p>\n<p>       Having regard to the nature of the injuries and the impact that the said<\/p>\n<p>injury has caused on the appellant, we are of the view that the appellant has<\/p>\n<p>to be granted a lump sum of Rs.50,000\/- as compensation under the head of<\/p>\n<p>permanent partial disability. We do so. Under all other heads the Tribunal<\/p>\n<p>has awarded reasonable compensation.          Therefore, the appellant is not<\/p>\n<p>entitled to get any enhancement under the other heads.
