SIRI JAGAN, J.\n              - - - - - - - - - - - - - - - - - - - - - - -\n                 W.P.(C)No. 27812 of 2010\n              - - - - - - - - - - - - - - - - - - - - - - -\n        Dated this the 30th day of November, 2010\n\n\n                        J U D G M E N T\n<\/pre>\n<p>     While working as a Forest Guard in the Forest<\/p>\n<p>Department of the Government of Kerala, the petitioner was<\/p>\n<p>suspended from service pending disciplinary proceedings by<\/p>\n<p>order dated 21.03.1996. A charge memo was issued on<\/p>\n<p>26.06.1996 and an enquiry was conducted. The same ended<\/p>\n<p>in an order imposing on him the punishment of withholding<\/p>\n<p>of two annual increments and treating the suspension<\/p>\n<p>period as leave. In the criminal case on the same set of<\/p>\n<p>facts the petitioner was acquitted.                      The petitioner<\/p>\n<p>challenged the punishment of withholding of increments in<\/p>\n<p>an appeal on the ground that the enquiry is vitiated for non-<\/p>\n<p>compliance with     the procedure prescribed.               By Ext.P4<\/p>\n<p>order, the 2nd respondent allowed the appeal and quashed<\/p>\n<p>the order of punishment on the ground of defect in the<\/p>\n<p>W.P.(C)No. 27812 of 2010<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><\/p>\n<p>enquiry, directing a denovo enquiry. That order was passed<\/p>\n<p>on 15.06.2001.          The petitioner&#8217;s grievance in this writ<\/p>\n<p>petition is that even now the denovo enquiry has not even<\/p>\n<p>begun. It is under the above circumstances the petitioner<\/p>\n<p>has filed this writ petition seeking the following reliefs:<\/p>\n<blockquote><p>      &#8220;i)   call for the records relating to Exhibit P-5;\n<\/p><\/blockquote>\n<blockquote><p>      ii)   issue a writ of certiorari to quash Exhibit P-5;\n<\/p><\/blockquote>\n<blockquote><p>      iii)  issue a writ of mandamus to the 3rd respondent to give all<br \/>\n            consequential benefits with interest since the barring of<br \/>\n            two annual increments and the suspension period based<br \/>\n            on Exhibit.P1 has been quashed by the 2nd respondent by<br \/>\n            Exhibit.P3&#8243;<\/p><\/blockquote>\n<p>      2.    The petitioner&#8217;s contention is that, if the denovo<\/p>\n<p>enquiry is conducted now after 14 years, the petitioner<\/p>\n<p>would not be in a position to defend himself properly in view<\/p>\n<p>of the passage of time and therefore the petitioner is<\/p>\n<p>seriously prejudiced.\n<\/p>\n<p>      3.    I have heard the learned Government Pleader<\/p>\n<p>also. The question as to whether the delay in conducting<\/p>\n<p>the enquiry in a disciplinary action vitiates the disciplinary<\/p>\n<p>proceedings itself has been subject matter of decisions of<\/p>\n<p>both this court and the Hon&#8217;ble Supreme Court in several<\/p>\n<p>W.P.(C)No. 27812 of 2010<br \/>\n<span class=\"hidden_text\">                             -3-<\/span><\/p>\n<p>decisions. Some of them are, State of Punjab &amp; Others<\/p>\n<p>Versus Prem Sarup (CDJ 2008 SC 1677), P.V. Mahadevan<\/p>\n<p>versus M.D., Tamil Nadu Housing Board (CDJ 2005 SC 592),<\/p>\n<p><a href=\"\/doc\/1570349\/\">Punjab National Bank, Human Resources Department and<\/p>\n<p>Others v. K. Prabhakaran<\/a> [2010 (1) KHC 704 (DB)],<\/p>\n<p>Mahadevan v. Tamil Nadu Housing Board [2005 (4) KLT<\/p>\n<p>SN 22 <a href=\"\/doc\/1524822\/\">(Case No.27) &amp; Thomas v. K.S.E.B<\/a> [2008 (3) KLT<\/p>\n<p>895]. In those decisions it was held that such delay would<\/p>\n<p>vitiate the proceedings as the same would cause serious<\/p>\n<p>prejudice to the delinquent in defending himself.<\/p>\n<p>      4.    The long delay in completing the disciplinary<\/p>\n<p>proceedings would certainly prejudice the delinquent<\/p>\n<p>insofar as by that time the documents in support of his<\/p>\n<p>contentions may not be available and the witnesses also<\/p>\n<p>may not be available.       In this case, the disciplinary<\/p>\n<p>proceedings were initiated as early as in 1996. Fourteen<\/p>\n<p>years have elapsed. The petitioner is due to retire from<\/p>\n<p>service on 31.3.2011.      As such, I am of opinion that,<\/p>\n<p>following the above decisions the disciplinary proceedings<\/p>\n<p>W.P.(C)No. 27812 of 2010<br \/>\n<span class=\"hidden_text\">                              -4-<\/span><\/p>\n<p>are    to    be    quashed.  Accordingly the   disciplinary<\/p>\n<p>proceedings are quashed and the writ petition is allowed as<\/p>\n<p>prayed for.\n<\/p>\n<\/p>\n<p>                                            S.
