Shri Veerappasiddararnappa Hulapalie,\nAged Major, Occ: Business, .\nR\/ o Vakkund, Bailhongal Taluk.\n\n(By Sri P.G.Chikkanaragund, Advocate for R513 .. 3 l\n\n..;&#039;Resp&#039;ondents  \n\nThis miscellaneous \ufb01rst appeal.__is \ufb011ed_u\/ s   \n\nagainst the judgment and award dt, 19.11.2Q04--._pa.ssed in MVC\nNo.16&quot;\/&#039;2 \/2000 on the \ufb01le of the Civil Judge {&#039;Sr.Dn.) and Addl.\nMACT, Saundatti and etc.     \n\nThis appeal Corning  day, the Court\ndelivered the following: * f &#039;   _ \n\nThe instaiiitl   against the impugned\njudgment  :5.  passed in MVC\nNo.176\/2000ll&#039;*on = the  MACT, Saundatti wherein the\nTribunal has awarded  l?s.2,41,000\/- with interest at 8%\nper&#039;annu5&#039;*o;3...ig1ccounAtxlofthe injuries sustained in the road traffic\n\naccidentr&#039;  &#039;The.&quot;coinpensation awarded is exorbitant and\n\n&#039;Vi&#039;egiisproportionateltothe nature of injuries suffered and liable to be\n\nPsu\u00e9bstantially reduced. Hence the present appeal by the insurer.\n\n   2}fI&#039;he brief facts of the case are:\n\n[L\n\n\n\nLo.)\n\nThe claimant is aged about 40 years. She is doing business\n\nin green gram and going frequently to the shandy in diffegrent\n\nvillages. On 05.08.2000 at about 12.30 hours when\n\ntravelling in a tempo, near Anigol on Bai1honga1~Be1w.adivRoad&quot;th\u00a7. \n\ntempo was being driven by its driver a-rash and-jnegv1--.igent\n\nmanner with high speed and the KSRT\n\n378 driven by its driver in a rash andnegligent__manri.er&#039;came&quot;from \n\nthe opposite direction and dashedx.a.gainst~~..the lgoodsjfehicle in\nwhich the appellant was travelling. a:i_dff.a::s  of this impact the\ninmates of the bus farid  susstainedhirijuries. The 15&#039;\n\nrespondent--c1aim__an.t\u00bb.  _fractu,refof leg below the knee\n\nand left leg  toilc.\u00a7&#039;\u00a3ii&#039;\u00a2i-- parts of the body. She\nwas immediately hospital Bailhongal and\nthereafter shiftedilto  treatment of fracture. She has\nundergorielitreaitnaent  a------period of 10 days as an impatient. It is\n\nthebcgaseiiof iptiiedalppelliant that she has spent considerable money\n\n&#039; i&#039;e~_t.owardsAIriedicaI&#039;e::15enses, conveyance and attendant charges on\n\n_h~.account of t.he\u00ab._injury sustained in the road traffic accident, she\n\n\u00abip\u00e9ilediijaiigclaim petition u\/ s 166 of the Motor Vehicles Act seeking\n\n._HA\u00ab4j..g91-\ufb01g\u00e9i\ufb02isation. The said clai  p before the Tribunal and\n\n\n\nthe Tribunal in turn after assessing the oral and documentary\n\nevidence on record allowed the appeal in part awarding arsum of\n\nRs.2,41,000\/- with interest at 8% per annum \n\npetition till the date of realisation on different drag&#039; it\n\ncompensation being excessive and disp:.&#039;oportiopn&#039;ate.;&#039;topithervnature\n\nof injuries sustained, the appellant~insu&#039;rer&#039;*.i_s befo_re&quot;us&#039;~ in &quot;this,\n\nappeal.\n\n3. I have heard learned.;:c&#039;o1.1nsel t.he:ap.pel1ant--insurer and\nthe learned counsel for the resp_on&quot;.dent~clai1nant--; After careful\n\nperusal of the jud\u00e9gnjent igangd--r.7aWard:_&quot;*uthefi compensation of\n\nRs. 10,000\/--.    medical expenses and\nRs. 10,000 \/- towards  is just and reasonable and\n\ndo not callfor interference. \n\n  the Tribunal has erred in awarding Rs.45,000\/--\n\ntoward.s&#039;\u00ab.i&#039;_pain:i:&quot;and.ii&#039;ps.uffering and another sum of Rs.45,000\/-\n\nVtoavards &#039;loss,fo&#039;f,amenities and discomfort is excessive as the\n\n hasundergone hospitalisation for only 10 days and the\n\ni&quot;dor_tor ihasiiassessed the disabi&#039; at 45% to the right lower limb\n\n\/\n\n\n\nand 30% to the whole body. The whole body disability taken at\n\n30% is on the higher side. If at all it has to be taken it sholu&#039;ld&quot;not\n\nbe more than 15% i.e., 1 \/3 of 45% as per the well  \n\ndown by Apex Court and this Court in a ho-st&quot;&#039;of:&#039;gj1.1idgIiieVnts.ii&#039;\n\nTherefore I feel it is just and proper to aiz;:ard.:&quot;a  3\n\ntowards pain and suffering and&#039;: toi\u00a7}aifd.s_ loft&#039;\n\namenities.\n\n5. Further the A&#039;I&quot;ribuna1V_Vhas grave error in\nawarding a sum  of future income\ntaking the iI&#039;lCOI&#039;\u00a3&#039;1i8:vV~ pm. and taking\n30% disabil:}&#039;t3i}iiiVtc5c*   monthly income of the\nclaimant at theirate of is on a lower side as the\naccident isof the&quot;~yearc2&#039;0Cii(3ii having regard to the age and\nQ_ccu.patioini&#039;~of_A-the.clairriantwho is doing business in selling green\n\ngralrngigoingi _fr&quot;or_n iiiiiage to village whenever there is a shandy, she\n\n objectiife andejor\ufb01mitted in her quest for survival, taking all\n\nbthese factors into consideration the income of the claimant is\n\n the rate of Rs.3,000\/~ pm. and the whole body\n\n.i&quot;iif:ii_s&#039;abi1ity  taken at 15% as stated supra and the appropriate\n\n\/\n\n\n\nmultiplier to be applied is 15 and a sum of Rs.81,000\/-- is awarded\n\nas against Rs.1,20,960\/- (Rs.3000 X 15\/ 100 x 12 X 15) award-ed by\n\nthe Tribunal.\n\n6. Having regard to the facts and circumstancesjof&#039;  \n\nthe instant appeal is allowed in part. Themimpugneci   &#039;V . \n\naward is modi\ufb01ed in the following termsig\n\nFuture loss of inconleg  &#039;\n\n -- &#039;Rs. 0,231,000\/--\n\nInjury,     \n\nRs. 0,530,000\/--\n\nMedical_VVex;enses &#039;  &#039;\n\nRs. o,10,o00\/-\n\nCrvjnvefarioe andpiattenidant charges\n\nRs. 0, 10,000\/--\n\nLoss of&#039;amenities.  \n\nRs. 0,530,000\/_\n\n.\n<\/pre>\n<p>5.\u00bb &#8221;\n<\/p>\n<p>Total<\/p>\n<p>RS.1,5l,000\/-\n<\/p>\n<p>&#8212;&#8211;v?\n<\/p>\n<p> a sum of Rs.1,51,000\/&#8211; is awarded as<\/p>\n<p>i cornprniisation as against a sum of Rs.2,41,000\/&#8211;<\/p>\n<p>&#8220;awarded by the Tribunal.
