Justice P.BHAVADASAN\n\n Dated :18\/10\/2010\n\n O R D E R\n<\/pre>\n<p>      THOTTATHIL.B.RADHAKRISHNAN &amp; P.BHAVADASAN, JJ.\n<\/p>\n<p>     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>                           FAO No.276 of 2010\n<\/p>\n<p>     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>                        Dated 18th October 2010<\/p>\n<p>                                  Judgment<\/p>\n<p>Bhavadasan, J.\n<\/p>\n<p>             OS       No.341\/02           before       the      Sub       Court,<\/p>\n<p>Chengannur was a suit for money against two persons. It<\/p>\n<p>related to a hire purchase loan in relation to a tipper lorry<\/p>\n<p>bearing       registration        no.KL-1\/B-7983.             The       second<\/p>\n<p>defendant in the suit was the guarantor for the financial<\/p>\n<p>arrangement between the plaintiff and the first defendant. It<\/p>\n<p>appears that the suit was decreed ex parte allowing the<\/p>\n<p>plaintiff to realise a           sum of Rs.5,31,949\/- with future<\/p>\n<p>interest @ 24% per annum on the principal amount of<\/p>\n<p>Rs.2,73,600\/- from the date of suit till realisation.<\/p>\n<p>             2. The defendants filed two applications namely<\/p>\n<p>IA Nos.239\/08 and 240\/08, to have the ex parte decree<\/p>\n<p>against them, set aside and also to condone the delay in<\/p>\n<p>filing the application to set aside the ex parte decree.<\/p>\n<p>According to them, they had not received summons from<\/p>\n<p><span class=\"hidden_text\">FAO No.276\/10                    2<\/span><\/p>\n<p>the Court and therefore, they did not appear. They say that<\/p>\n<p>they have strong contentions to urge before Court.<\/p>\n<p>           3. Since the defendants were absent and they<\/p>\n<p>were not represented, the court below dismissed IA<\/p>\n<p>No.239\/08 by order dated 13.08.2008. Consequently, the<\/p>\n<p>application to set aside the ex parte decree was also<\/p>\n<p>dismissed. The said order is assailed in this appeal.<\/p>\n<p>4. There is nothing to indicate that there was any deliberate<\/p>\n<p>act on the part of the defendants in not appearing before<\/p>\n<p>the court below on the date when IA No.239\/08 was<\/p>\n<p>posted. The defendants have stated that they have very<\/p>\n<p>strong contentions to urge in reply to the plaintiff&#8217;s claim<\/p>\n<p>and that the decree was obtained without actually serving<\/p>\n<p>summons on them. They had also filed a petition to set<\/p>\n<p>aside the ex parte decree and to condone the delay.<\/p>\n<p>           4. Considering the facts and circumstances of<\/p>\n<p>the case, it is felt that an opportunity ought to have been<\/p>\n<p>given to the defendants to have the applications filed by<\/p>\n<p>them, heard on merits, since it is improper for the court<\/p>\n<p><span class=\"hidden_text\">FAO No.276\/10                   3<\/span><\/p>\n<p>below to have dismissed IA No.239\/08 for default.<\/p>\n<p>However, it cannot be said that there was absolutely no<\/p>\n<p>laches on the part of the defendants. If at all any injury is<\/p>\n<p>caused to the plaintiff, that may be compensated by<\/p>\n<p>awarding costs.\n<\/p>\n<p>           5. In the result, this appeal is allowed. The<\/p>\n<p>impugned order is set aside and IA Nos.239\/08 and 240\/08<\/p>\n<p>are restored to file on condition that the petitioner before<\/p>\n<p>this court pays to the counsel for the respondent herein a<\/p>\n<p>sum of Rs.5,000\/- (Rupees Five Thousand only) within two<\/p>\n<p>weeks from today.
