DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 68\/2010 with Aagthala Police Station, Banaskantha for the<br \/>\n\toffences punishable under Sections 326, 323, 504, 506(2), 307 &amp;<br \/>\n\t114 of the Indian Penal Code and Section 135 of the Bombay Police<br \/>\n\tAct.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicants submits that in a dispute of civil nature<br \/>\n\twhere Regular Civil Suit No.118 of 23010 was filed and pursuant to<br \/>\n\tthat application for appointment of the Court Commissioner was also<br \/>\n\tsubmitted. Even, apprehending the likelihood of disturbance of piece<br \/>\n\tand law and order, the Executive Magistrate, Deesa had addressed a<br \/>\n\tcommunication to PSI, Aagthala Police Station, Deesa Taluka,<br \/>\n\tSabarkantha, but no police protection was given. It is further<br \/>\n\tsubmitted that on service of notice, the other side entered into<br \/>\n\tdisputed land on which a panchnama was drawn by the court<br \/>\n\tcommissioner, which reveals possession of the applicants herein.<br \/>\n\tEven, considering the nature of injuries and dispute between the<br \/>\n\tparties, the applicant deserves to be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences, without discussing the evidence<br \/>\n\tin detail, at this stage, I am inclined to grant anticipatory bail<br \/>\n\tto the applicants.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicants herein being arrested pursuant to FIR being<br \/>\n\tCR No.I 68\/2010 registered with Aagthala Police Station,<br \/>\n\tBanaskantha,  the applicants shall be released on bail on furnishing<br \/>\n\ta bond of Rs.5,000\/- (Rupees Five Thousand only) with one surety of<br \/>\n\tlike amount on following conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 31.12.1010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file application\/s for<br \/>\n\tremand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicants are arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>With<br \/>\n\tthese directions, this Criminal Misc.
