Justice P.S.GOPINATHAN\n\n Dated :28\/05\/2010\n\n O R D E R\n         C.N.RAMACHANDRAN NAIR &amp; P.S.GOPINATHAN, JJ.\n                         ---------------------------\n                        W.A No. 857 OF 2010\n                         --------------------------\n                 Dated this the 28thday of May, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<\/p>\n<p>      The appeal is filed against the judgment of the learned Single<\/p>\n<p>Judge directing the Manager of the school to consider the<\/p>\n<p>disciplinary proceedings against the appellant.         The contention of<\/p>\n<p>the learned counsel appearing for the appellant is that the appellant<\/p>\n<p>was found to be involved in an act of indiscipline in as much as he<\/p>\n<p>conducted a sit in strike in the school and the Director had already<\/p>\n<p>imposed a punishment of warning.                   However, the Manager<\/p>\n<p>approached the Government stating that higher punishment is<\/p>\n<p>called for and he should be given the freedom to take decision.<\/p>\n<p>Since the Government did not act upon the Manager&#8217;s appeal, he<\/p>\n<p>came to this Court which upheld the Manager&#8217;s right to take<\/p>\n<p>disciplinary action against the appellant. It is this decision that is<\/p>\n<p>under challenge in this appeal.\n<\/p>\n<p>      2. The main contention raised by the counsel is that when the<\/p>\n<p>matter is taken up for consideration by the Government in an appeal<\/p>\n<p>by the Manager, he cannot simultaneously approach this Court to<\/p>\n<p>W.A..No.857\/2010<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>establish his right as manager. The counsel relied on the judgment<\/p>\n<p>of the Division Bench of this Court in <a href=\"\/doc\/1129222\/\">Saji Varghese v.<\/p>\n<p>Mohammedkutty and Others<\/a> (2009 (4) KHC 44) on the contention<\/p>\n<p>that once the matter is pending before the statutory authority this<\/p>\n<p>Court should not have interfered in writ proceedings.
