Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :14\/07\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                   W.P(C).No.23319 OF 2008\n                  -------------------------------------------\n               Dated this the 14th day of July, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p>1.A seven storeyed shopping mall &#8220;Sky Hotel cum Shopping<\/p>\n<p>  Arcade&#8221;, spread over more than 1 lakh square feet area,<\/p>\n<p>  belongs to a partnership firm of which the petitioner is the<\/p>\n<p>  managing partner. Going by the writ petition, the ground floor<\/p>\n<p>  and the three floors immediately above that accommodate<\/p>\n<p>  jewellery, textiles, outlet for different other articles, food<\/p>\n<p>  court, beauty parlour etc.               The 3rd, 4th and 5th floors<\/p>\n<p>  accommodate a hotel by name &#8220;Voyage&#8221; which has 3 star<\/p>\n<p>  classification.    There are 32 rooms which can be let out.<\/p>\n<p>  According to the petitioner, the existence of a bar is required<\/p>\n<p>  for 4 star classification by the Directorate of Tourism,<\/p>\n<p>  following recommendation of the Hotel and Restaurant<\/p>\n<p>  Approval and Classification Committee. The application for<\/p>\n<p>  licence to run a bar in terms of the Foreign Liquor Rules<\/p>\n<p>  stands   rejected    by     the      Excise       Commissioner, though<\/p>\n<p>WPC.23319\/08<\/p>\n<p>                            Page numbers<\/p>\n<p>  recommended by the Assistant Excise Commissioner. This is<\/p>\n<p>  under challenge.\n<\/p>\n<\/p>\n<p>2.  In     Ext.P4  recommendation      of  the    Assistant   Excise<\/p>\n<p>  Commissioner, he found that the proposed bar will not be<\/p>\n<p>  within any objectionable area having regard to the distance<\/p>\n<p>  that the floors accommodating the hotel has, from any nearby<\/p>\n<p>  educational institution. He also reported that there is cluster<\/p>\n<p>  of institutions, educational, residential, religious etc., situated<\/p>\n<p>  in the complex. He recommended the grant of licence. It has<\/p>\n<p>  to be immediately recalled that in terms of Rule 13-B of the<\/p>\n<p>  Foreign Liquor Rules, an application has to be made to the<\/p>\n<p>  Excise     Commissioner     through    the     Assistant    Excise<\/p>\n<p>  Commissioner as the law then stood.            It is stated that<\/p>\n<p>  subsequently, there was a christening of the post of Assistant<\/p>\n<p>  Excise Commissioner. Whatever that be, Rule 13-B requires<\/p>\n<p>  the Assistant Excise Commissioner to ensure into all points<\/p>\n<p>  mentioned in the Rules and submit the application to the<\/p>\n<p>  Commissioner with his report. In the case in hand, it does not<\/p>\n<p>WPC.23319\/08<\/p>\n<p>                             Page numbers<\/p>\n<p> appear that any other report was called for by the Excise<\/p>\n<p> Commissioner in terms of Rule 13-B(1) from any other officer.<\/p>\n<p> While      forwarding  the   report    of the Assistant    Excise<\/p>\n<p> Commissioner and the application of the petitioner to the<\/p>\n<p> Excise Commissioner, the Deputy Excise Commissioner stated<\/p>\n<p> in his letter that the distance between the main entrance of the<\/p>\n<p> shopping complex housing the hotel and the objectionable<\/p>\n<p> premises viz., schools, religious institutions etc., is less than<\/p>\n<p> the permissible limit.     In the impugned Ext.P7 order, the<\/p>\n<p> Excise Commissioner has essentially culled out from the<\/p>\n<p> Assistant Excise Commissioner&#8217;s report, only that portion<\/p>\n<p> which relates to the existence of the educational and religious<\/p>\n<p> institutions and then, had taken into consideration the views of<\/p>\n<p> the Deputy Excise Commissioner, however, totally ignoring the<\/p>\n<p> views of the Assistant Excise Commissioner, particularly in the<\/p>\n<p> 3rd and 4th paragraphs of Ext.P4, stating the reasons why he<\/p>\n<p> recommends the application for grant.        In his report, the<\/p>\n<p> Assistant Excise Commissioner has stated that on physical<\/p>\n<p> verification of the total complex, the ground, first and second<\/p>\n<p>WPC.23319\/08<\/p>\n<p>                             Page numbers<\/p>\n<p>  floors are seen to be used exclusively for shopping purpose<\/p>\n<p>  and the hotel starts only from the third floor onwards. With<\/p>\n<p>  the aforesaid statutory recommendation on record, it was not<\/p>\n<p>  advisable for the Excise Commissioner to eschew that part of<\/p>\n<p>  Ext.P4 report which was in favour of the petitioner. Even if<\/p>\n<p>  that were to be rejected, the principles relatable to exercise of<\/p>\n<p>  statutory executive power require statement of reasons for<\/p>\n<p>  overruling the views of the Assistant Excise Commissioner. It<\/p>\n<p>  also needs to be noticed that Ext.P6 report of the Deputy<\/p>\n<p>  Commissioner does not touch upon the manner in which the<\/p>\n<p>  measurement is made by the Assistant Excise Commissioner.<\/p>\n<p>3. With the aforesaid in view, it needs to be taken note of, that<\/p>\n<p>  according to the petitioner, Ext.P8 is a judgment of this Court<\/p>\n<p>  rendered by the Division Bench, wherein, the calculation of the<\/p>\n<p>  distance in terms of the distance rule in relation to cluster of<\/p>\n<p>  institutions is dealt with.  Learned counsel for the petitioner<\/p>\n<p>  stated that the decision of this Court in <a href=\"\/doc\/1368389\/\">Vijayakumar v. State<\/p>\n<p>  of Kerala<\/a> [2009(1) KLT 578] is also relevant. It is stated that<\/p>\n<p>WPC.23319\/08<\/p>\n<p>                            Page numbers<\/p>\n<p>  the distance ought not be measured from the main and<\/p>\n<p>  composite entry but has to be measured from the gate of each<\/p>\n<p>  individual institution which could be treated as objectionable.<\/p>\n<p>  It is submitted that the Government had implemented the<\/p>\n<p>  effect of such judgment and if that is applied, even going by<\/p>\n<p>  the measurements from the respective gates of the different<\/p>\n<p>  establishments in the cluster of institutions, there would be no<\/p>\n<p>  objectionable situation. It is further pointed out on behalf of<\/p>\n<p>  the petitioner that    a bar licence being a necessary pre-<\/p>\n<p>  condition for gaining star 4 classification going by Ext.P2<\/p>\n<p>  guidelines, it was unreasonable to deprive the petitioner of<\/p>\n<p>  such status by refusing the grant of bar licence as ought for.<\/p>\n<p>4. Immediately, among the different decisions relied on by the<\/p>\n<p>  learned Government Pleader in which this Court had<\/p>\n<p>  expressed on the modality of the application of the distance<\/p>\n<p>  rule, he referred to the decisions in Ravindran v. George<\/p>\n<p>  [1993(1) KLT 792], Mohan v. Moidu [1993(1) KLT 425],<\/p>\n<p>WPC.23319\/08<\/p>\n<p>                           Page numbers<\/p>\n<p> K.V.Ramakrishnan v. State [1993(2) KLJ 1033] and in<\/p>\n<p> <a href=\"\/doc\/47071\/\">Joseph v. Excise Commissioner<\/a> [1988(2) KLT 913].<\/p>\n<p>  Having noted that the Excise Commissioner has issued the<\/p>\n<p> impugned order totally ignoring the findings of the Assistant<\/p>\n<p> Excise Commissioner on physical verification of the premises,<\/p>\n<p> it is appropriate that the matter is re-considered by the Excise<\/p>\n<p> Commissioner after providing the petitioner an opportunity of<\/p>\n<p> hearing, including on the question as to the applicability of the<\/p>\n<p> decisions afore-referred.   Let this be done within a period of<\/p>\n<p> two months from the date of receipt of a copy of this judgment<\/p>\n<p> To aid such process, the impugned Ext.P7 is quashed.
