Mukerjee,   J.  <\/p>\n<p> 1. This is a summary suit under Order XXXIII<br \/>\nCPC for recovery of Rs. 9,35,506.93\/-. The defendant<br \/>\nNo. 1 is the firm while the defendants No. 2 to 5 were<br \/>\nthe partners. The defendants No. 2, 4 to 5 are stated<br \/>\nto have expired and as such only defendants No. 3 is the<br \/>\nsurviving partner. The defendants are jointly and<br \/>\nseverally liable, and the plaintiff is not aware of the<br \/>\naddresses or particulars of any of the LRs of other<br \/>\ndeceased defendants.\n<\/p>\n<p> 2. Vide order, dated 29.8.2001, the defendant<br \/>\nhad been granted conditional leave to contest this<br \/>\nsummary suit upon making deposit, of Rs. 5 lakh. The<br \/>\nsaid conditional order was never complied with, not<br \/>\neven till date.\n<\/p>\n<p> 3. There is also no appearance on behalf of the<br \/>\ndefendants, and the counsel earlier appearing, has<br \/>\nstopped appearing after informing about the demise of<br \/>\none of the defendants.\n<\/p>\n<p> 4. In view of the non compliance with the<br \/>\nconditional order of this Court dated 29.8.2001, it<br \/>\nfollows that the application for leave to contest is to<br \/>\nbe deemed to have been dismissed with the consequence<br \/>\nthat the decree is to be passed against the defendants<br \/>\nNo. 1 and 3 for the suit amount.\n<\/p>\n<p> 5. I have gone through the averments of the<br \/>\nplaintiff which are duly verified and I am satisfied<br \/>\nthat the suit amount based on three dishonoured cheques<br \/>\ntotalling Rs. 9,01,844.54\/- Along with bank charges and<br \/>\ninterest, after adjustment of part payment and credit<br \/>\non account of claims lodged by the defendant, left an<br \/>\noutstanding of Rs. 5,61,866.04\/- which Along with<br \/>\ninterest @ 21% per annum from 5.8.1992 to 5.10.1995<br \/>\namounting to Rs. 3,73,640.89\/-, totals to<br \/>\nRs. 9,35,506.93\/-.\n<\/p>\n<p> 6. The suit is accordingly decreed against <\/p>\n<p>defendants     1     &amp;  3  for  the  amount     of     Rs. 9,35,506.93\/-<br \/>\nwith  pendente  lite  and  future  interest  at  the  same  rate<br \/>\ni.e.    @     21%  per   annum  with  quarterly     rests     pendente<br \/>\nlite     and     for     future     period  up to     date     of     payment,<br \/>\nsubject     to     the     condition     that        in     the     event       of<br \/>\ndefendants     making    payment  of  all   the  suit  amounts     in<br \/>\nquestion  i.e.     Rs. 9,35,506.93\/-  within  a  period  of  four<br \/>\nmonths     from     today,  will  be  entitled  to  lower  rate     of<br \/>\ninterest     at     9%     by  way  of  pendente     lite     and     future<br \/>\ninterest.\n<\/p>\n<p> 7.
