L. Jani waives service<br \/>\nof Rule on behalf of the respondent-State.  In the facts and<br \/>\ncircumstances of the case, the matter is taken up for hearing today.\n<\/p>\n<p>2.\t\tThis<br \/>\nis an application preferred under Section 439 of the Code of Criminal<br \/>\nProcedure seeking regular bail of the petitioner in connection with<br \/>\nFIR bearing C. R. No. I-8 of 2008 filed at Alang Police Station,<br \/>\nDistrict:- Bhavnagar for the offences punishable under Sections 395,<br \/>\n457, 347, 504 and 120B of the Indian Penal Code and under Section 135<br \/>\nof the Bombay Police Act.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate Mr. T. R. Savani for the petitioner submitted that a false<br \/>\ncase is foisted on the petitioner which can be seen from the FIR at<br \/>\nAnnexure-A to the petition.  The learned Advocate further submitted<br \/>\nthat no overt act can be alleged against the present petitioner and,<br \/>\ntherefore, the prayer, as set out in the petition, deserves to be<br \/>\ngranted.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdditional Public Prosecutor Mr. H. L. Jani representing the State<br \/>\nsubmitted that the petitioner has been booked for the offences<br \/>\npunishable under Sections 395, 457, 347, 504 and 120B of the Indian<br \/>\nPenal Code and under Section 135 of the Bombay Police Act.<br \/>\nConsidering the role attributed to the petitioner and the manner in<br \/>\nwhich the offences are committed by petitioner along with other<br \/>\naccused persons, the petition deserves to be rejected.\n<\/p>\n<p>5.\t\tHaving<br \/>\nconsidered the rival submissions and on perusal of the averments made<br \/>\nin the petition as well as the FIR at Annexure-A to the petition, the<br \/>\npetitioner is booked for the offences punishable under Sections 395,<br \/>\n457, 347, 504 and 120B of the Indian Penal Code and under Section 135<br \/>\nof the Bombay Police Act.  I have perused the FIR wherein the name of<br \/>\nthe petitioner does not figure.  Prima<br \/>\nfacie even the involvement of the petitioner is not indicated<br \/>\nin the FIR.  In view of the above, I am inclined to exercise my<br \/>\ndiscretion in favour of the petitioner without entering into the<br \/>\nmerits of the case.\n<\/p>\n<p>6.\t\tFor<br \/>\nthe foregoing reasons, the petition is allowed. The petitioner is<br \/>\nordered to be enlarged on bail in connection with C. R. bearing No.<br \/>\nI-8 of 2008 filed at Alang Police Station for the offences punishable<br \/>\nunder Sections 395, 457, 347, 504 and 120B of the Indian Penal Code<br \/>\nand Section 135 of the Bombay Police Act on executing a bond of<br \/>\nRs.10,000\/- [Rupees Ten Thousand Only] with one surety of the like<br \/>\namount to the satisfaction of the Trial Court and subject to the<br \/>\nconditions that he shall:\n<\/p>\n<p>[a]<br \/>\n\tnot take undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]<br \/>\n\tsurrender his passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]<br \/>\n\tnot leave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>[e]<br \/>\n\tmark his presence at concerned police station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM till<br \/>\nthe trial is over;\n<\/p>\n<p>[f]<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\nOfficer and also to the Court at the time of execution of the bond<br \/>\nand shall not change his residence without prior permission of this<br \/>\nCourt; and,<\/p>\n<p>[g]<br \/>\n\tmaintain law and order.\n<\/p>\n<p>7.<br \/>\n\t\tIf breach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.<br \/>\n\t\tBail bond to be executed before the lower Court having jurisdiction<br \/>\nto try the case.\n<\/p>\n<p>9.<br \/>\n\t\tAt the trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature qua the evidence at this stage<br \/>\nmade by this Court while enlarging the petitioner on bail.\n<\/p>\n<p>10.<br \/>\n\t\tRule is made absolute.
