Advocate,Mahipal Singh\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Shyam Shankar Tiwari,J.\n<\/p>\n<p>Heard Sri Rajesh Singh and Mohd. Umar Khan who appeared to<br \/>\npress bail application moved on behalf of Gayasuddin s\/o<br \/>\nFakruddin and Waqar alias Bhura s\/o Bada and learned Additional<br \/>\nGovernment Advocate for the State.\n<\/p>\n<p>Applicants above named were prosecuted for the offence<br \/>\npunishable under Sections so mentioned in the judgment and they<br \/>\nare to serve out the sentence so provided.\n<\/p>\n<p>Submission is that there were four accused. Initially the<br \/>\nprosecution case is that all the four accused inflicted knife and<br \/>\n&#8216;Lathi injury to the deceased but then it is stated that knife blow by<br \/>\nwhich the deceased received several injuries are by Gayasuddin<br \/>\nand Waqar thereafter used his Lathi.\n<\/p>\n<p>Although in respect to the role of Waqar alias Bhura by using<br \/>\nLathi there are variations but there is one injury of blunt object and<br \/>\nknife injury.\n<\/p>\n<p>Submission is that appellants were on bail during the trial and they<br \/>\ndid not misuse the same.\n<\/p>\n<p>Learned Additional Government Advocate submits that Trial<br \/>\nJudge believed the prosecution version and accepted the<br \/>\nparticipation of both the appellants and the injuries received by the<br \/>\ndeceased by use of both the weapons i.e. knife and Lathi and thus<br \/>\nafter conviction then it is not a fit case for bail.\n<\/p>\n<p>Initially the case was that all the four accused used knife thereafter<br \/>\nin the evidence it has come that Gayasuddin inflicted the knife<br \/>\ninjury. Bhura is said to have used Lathi. Trial Judge also convicted<br \/>\nGayasuddin under Section-302 IPC and Waqar alias Bhura under<br \/>\nSection-302 readwith Section-34 IPC.\n<\/p>\n<p>The number of injuries which can be said to be fetal on the body of<br \/>\n the deceased has been found of the knife and Waqar alias Bhura is<br \/>\nsaid to have used Lathi.\n<\/p>\n<p>Appeal is not so old and thus it will take long time in its disposal,<br \/>\nthus the appellant is entitled to be enlarged on bail.\n<\/p>\n<p>On the facts and totality of the circumstances this Court of the<br \/>\nconsidered view that bail application of appellant no.1 Gayasuddin<br \/>\ns\/o Fakruddin is to be rejected and same time appellant no.2<br \/>\nWaqar alias Bhura is entitled to be enlarged on bail.\n<\/p>\n<p>Realization of fine in respect to appellant no.2 Waqar alias Bhura<br \/>\nto the extent of fifty percent shall remain stayed. Balance amount<br \/>\nof fine shall be deposited forthwith.
