Srivastava appears for Dr. Pragya Agrawal-respondent no. 6.\n<\/p>\n<p>A dispute of seniority, between the petitioner and the respondent<br \/>\nno. 6, appointed on adhoc basis on the same day, on 29.3.1988, in<br \/>\npursuance to the recommendation of Selection Committee, in<br \/>\nwhich respondent no. 6 was placed higher in merit than the<br \/>\npetitioner, after which both the petitioner and respondent no. 6<br \/>\nwere regularized on the same day on 26.6.1992 under Section 31-\n<\/p>\n<p>(c) of the U.P. Higher Education Service Commission Act, 1980,<br \/>\nthereby getting appointment in substantive capacity, has been<br \/>\ndecided by the Committee of Management of the College on the<br \/>\nbasis of the decision of the Vice Chancellor of the University dated<br \/>\n7.1.2000. The Vice Chancellor held that when two or more persons<br \/>\nare appointed as teachers in the same department or in the same<br \/>\nsubject, on same day, according to Statute 18.13 of the Statutes of<br \/>\nthe University, their relative seniority shall be determined in order<br \/>\nof preference or merit in which their names were recommended by<br \/>\nthe Selection Committee.\n<\/p>\n<p>The Statutes of the University, relating to seniority of Principal<br \/>\nand Teachers of affiliated Colleges, with which we are concerned,<br \/>\nare given in Part II as follows:-\n<\/p>\n<p>&#8220;Part II<\/p>\n<p>Seniority of Principals and Teachers of affiliated Colleges<br \/>\n18.10: The following rule shall be followed in determining the seniority of<br \/>\nPrincipal and other teachers of affiliated colleges:\n<\/p>\n<p>(a) The Principal shall be deemed senior to other teachers in the college;\n<\/p>\n<p>(b) The Principal of Post Graduate College shall be deemed senior to the<br \/>\n Principal of Degree College;\n<\/p>\n<p>(c) The seniority of Principals and Teachers of the affiliated colleges shall<br \/>\nbe determined by the length of continuous service from the date of<br \/>\nappointment in substantive capacity;\n<\/p>\n<p>(d) Service in each capacity (for example, as Principal or as a teacher),<br \/>\nshall be counted from the date of taking charge pursuant to substantive<br \/>\nappointment;\n<\/p>\n<p>(e) Service in each a substantive capacity in another University or<br \/>\nanother Degree or Post Graduate College whether affiliated to or<br \/>\nassociated with the University or another University established by law<br \/>\nshall be added to his length of service.\n<\/p>\n<p>18.11 Where more than one teachers are entitled to count the same length<br \/>\nof continuous service, the relative seniority of such teacher shall be<br \/>\ndetermined as below:(Section 49(o))<\/p>\n<p>(i) In the case of Principals, the length of substantive service as a<br \/>\nLecturer shall be taken into consideration;\n<\/p>\n<p>(ii) In the case of Lecturers, the seniority in age shall be taken into<br \/>\nconsideration.\n<\/p>\n<p>18. 12 Where the seniority of a person as Principal is to be determined<br \/>\nfor the purposes of representation or appointment as such on an<br \/>\nUniversity Authority, length of service only as Principal shall be taken<br \/>\ninto account(Section 49(o).\n<\/p>\n<p>18.13(1) When two or more persons are appointed as teachers in the<br \/>\nsame department or in the same subject, the relative seniority shall be<br \/>\ndetermined in order of preference or merit in which their names were<br \/>\nrecommended by the selection committee.\n<\/p>\n<p>(2) If the seniority of two or more teachers has been determined under<br \/>\nclause (1), the same shall be communicated to the teachers concerned<br \/>\nbefore their appointment.\n<\/p>\n<p>18.14. All disputes regarding seniority of teachers (other than the<br \/>\nPrincipal), shall be decided by the Principal of the college who shall give<br \/>\nreasons for the decision. Any teacher aggrieved by the decision of<br \/>\nPrincipal may prefer an appeal to the Vice Chancellor within sixty days<br \/>\nfrom the date of communication of such decision to the teachers<br \/>\nconcerned. If the Vice Chancellor disagrees from the Principal, he shall<br \/>\ngive reasons for such disagreement.(Section 49 (o) )<\/p>\n<p>18.15 All disputes regarding seniority of Principal of affiliated colleges<br \/>\nshall be decided by the Vice Chancellor who shall give reasons for the<br \/>\ndecision. Any Principal aggrieved by the decision of Vice Chancellor may<br \/>\nprefer an appeal to the executive council within 60 days from the date of<br \/>\ncommunication of such decision to the Principal concerned. If the<br \/>\nexecutive council disagrees with the Vice Chancellor, it shall give reason<br \/>\n for such disagreement. (Section 49 (o).\n<\/p>\n<p>18.16 The provisions of Statutes 18.01, 18.02, 18.05 and 18.08 shall<br \/>\nmutatis mutandis apply to the teachers and Principals of affiliated<br \/>\ncolleges as they apply to the teachers of the University. (Section 49 (O).&#8221;\n<\/p>\n<p>Shri Anil Bhushan submits that the Principal of the College had<br \/>\ndecided the seniority, which was continued for a long period of<br \/>\ntime. The post of Head of Department had fallen vacant on<br \/>\n1.7.2010, on which respondent no. 6 raised the issue for the first<br \/>\ntime to decide her seniority in accordance with the Statute 18.13<br \/>\n(1). The Committee of Management has upset the long standing<br \/>\nseniority between the petitioner and respondent no.6.\n<\/p>\n<p>It is submitted by Shri Anil Bhushan, that Statute 18.11 takes into<br \/>\naccount the seniority in age in case of substantive appointment on<br \/>\nthe same day. The petitioner is senior in age, born on 19.9.1963 as<br \/>\ncompared to respondent no. 6, born on 4.6.1965. The Statute 18.11<br \/>\nwill prevail over Statute 18.13. He submits that the appointment of<br \/>\nboth the petitioner and respondent no. 6 was initially on adhoc<br \/>\nbasis. The recommendation of the Selection Committee for adhoc<br \/>\nappointment will not be relevant as both the petitioner and<br \/>\nrespondent no. 6 were regularized under Section 31-(c) of the Act<br \/>\non the same day on 26.6.1992. The rule of seniority in age under<br \/>\nStatute 18.11 (ii) will prevail. He further submits that the decision<br \/>\nof the Principal is final and that since no appeal was filed by<br \/>\nrespondent no. 6 before the Vice Chancellor, she cannot re-agitate<br \/>\nthe matter at the time of appointment as Head of Department to be<br \/>\nthe senior most teacher, after 22 years.\n<\/p>\n<p>Shri P.S. Baghel, Senior Advocate appearing for the Committee of<br \/>\nManagement would submit that though the matter should be<br \/>\ndecided by the Vice Chancellor, but since Statute 18.13 comes<br \/>\nlater to Statute 18.11, and clarifies that where two or more persons<br \/>\nare appointed as teachers in the same department and in the same<br \/>\nsubject, their relative seniority has been determined in accordance<br \/>\nwith the preference or merit in which their names were<br \/>\nrecommended by the Selection Committee.\n<\/p>\n<p>It is not denied that the respondent no. 6 was placed at serial No. 1<br \/>\nby the Selection Committee, in which there was one nominee of<br \/>\nthe Vice Chancellor and that the recommendations were accepted<br \/>\nby the University in the same order. The substantive appointment<br \/>\nonly changes the nature of appointment. Even if both the petitioner<br \/>\nand respondent no. 6 were appointed on the same day in<br \/>\nsubstantive capacity, Stature 18.13 would be applicable and if both<br \/>\n persons were appointed in the same department and same subject,<br \/>\nit would again have prevailed.\n<\/p>\n<p>We find that the Statutes are absolutely clear on the subject and<br \/>\nthus there is no question of relegating the matter to the Vice<br \/>\nChancellor, who has already decided the matter in a case of Shri<br \/>\nJai Shanker Prasad, on 7.1.2009, and has taken the same view. We<br \/>\ncan take help from his decision in deciding this matter.\n<\/p>\n<p>Statute 18.13 falls later than the Statute 18.11 in the order of<br \/>\nStatutes for determination of seniority. The adhoc appointment<br \/>\ngets converted into regular appointment under Section 31-(c) of<br \/>\nthe Act of 1980, without any fresh selections on merits, and thus<br \/>\nsince both the petitioner and respondent no. 6 were appointed on<br \/>\nadhoc basis on the same day and were given substantive<br \/>\nappointment on the basis of the same selections on comparative<br \/>\nmerit. Their seniority would be arranged in order of merit and will<br \/>\nbe governed by the Statute 18.13 (i), and not Statute 18.11 (ii).\n<\/p>\n<p>Statute 18.13 (i) does not refer to the nature of appointment. It is<br \/>\nattracted where two or more persons are appointed as teachers<br \/>\n(including posts other than Lecturers) in the same department or in<br \/>\nthe same subject. It deals with specific cases, in which the two or<br \/>\nmore persons are appointed in same selections, as in the present<br \/>\ncase. Statute 18.11 applies where two or more teachers (including<br \/>\nother posts) are entitled to count the same length of continues<br \/>\nservice. In case of Principal, the length of substantive service as<br \/>\nLecturer, and in case of Lecturer, the seniority in age in such case,<br \/>\nwill be determinative factor. Both situations may arise in a same<br \/>\ncase. Where however the teacher are of the same department or in<br \/>\nsame subject and were selected in same selections (the nature of<br \/>\npost or selections is not specified in Statute 18.13 (i) ), as a special<br \/>\ncase their seniority, by specific reference to Statute 18.13 (i), will<br \/>\nbe determined in order of preference or merit in which their names<br \/>\nwere recommended by Selection Committee. The special clauses<br \/>\ncovered by Statute 18.13 (i), will prevail over the general clause in<br \/>\nStatute 18.11 (ii). The petitioner&#8217;s regularisation was not<br \/>\nconditional, as in the case of <a href=\"\/doc\/173865\/\">M.P. Palaniswamy &amp; others vs.<br \/>\nGovernment of T.N.
