Justice ANTONY DOMINIC\n\n Dated :09\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                 W.P.(C) NO. 2269 OF 2010 (G)\n                 =====================\n\n         Dated this the 9th day of September, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>     Petitioners are businessmen who are carrying on their<\/p>\n<p>business at Nattika in Trichur District. Their complaint is that<\/p>\n<p>persons\/institutions are putting up      large hoardings and flex<\/p>\n<p>boards on the side of the National Highway virtually blocking their<\/p>\n<p>shop buildings from the public view. It is stated that even if the<\/p>\n<p>same is removed, that will be replaced immediately thereafter, as<\/p>\n<p>a result of which, the hoardings are always installed at the site. It<\/p>\n<p>is in these circumstances, the writ petition is filed seeking<\/p>\n<p>direction to the respondents to remove the hoardings and flex<\/p>\n<p>boards put up at the sides of the National Highway coming within<\/p>\n<p>the jurisdiction of the 2nd respondent Panchayat.<\/p>\n<p>     2.     Learned Government Pleader who has obtained<\/p>\n<p>instructions from the 3rd respondent, submits that on the filing of<\/p>\n<p>the writ petition, hoardings and flex boards have all been<\/p>\n<p>removed. However, counsel for the petitioners submit that the<\/p>\n<p>hoardings\/flex boards have been duly replaced and are continuing<\/p>\n<p>even now.      The factual position as canvassed by the leaned<\/p>\n<p>WPC No. 2269\/10<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>counsel for the petitioners is not disputed by the 2nd respondent<\/p>\n<p>also.\n<\/p>\n<p>      3.   Admittedly, the property in question is that of the 1st<\/p>\n<p>respondent.    If any unauthorised hoardings or flex boards are<\/p>\n<p>installed, necessarily it is for the 1st respondent to take<\/p>\n<p>appropriate action in the matter.
