Pleader\n\n:J U D G M E N T\n<\/pre>\n<p>        The  substantive  prayer  in  the  writ  petition  is to issue writ of<br \/>\ncertiorarifed  mandamus  for  quashing  the  proceedings   Rco.3\/02\/c2   dated<br \/>\n27.3.2003  and directing the first respondent to issue C Form licence to the<br \/>\npetitioner under the Tamil Nadu Cinemas  (Regulation)  Act,  1955,  read  with<br \/>\nTamil Nadu Cinema (Regulation) Rules, 1957.\n<\/p>\n<p>        2.  Petitioner  is  the Managing Partner of Sri Manjunatha Talkis.  An<br \/>\napplication has been filed on  behalf  of  the  petitioner  before  the  first<br \/>\nrespondent for  location  of  permanent  cinema theatre.  Initially, the first<br \/>\nrespondent issued No Objection Certificate for a period of three years  for  a<br \/>\nsemi-permanent theatre.    However, subsequently NOC was granted for permanent<br \/>\ntheatre and the building plan had been accordingly approved.  The  petitioner,<br \/>\nhowever,  had  not  completed  the  building  within  the  stipulated  period.<br \/>\nSubsequently on 4.1.1995, the petitioner filed  a  representation  before  the<br \/>\nCollector  indicating  that  substantial  portion  of  the  building  has been<br \/>\nconstructed and a fresh NOC may be  issued.    However,  at  that  stage,  the<br \/>\nCollector  refused to grant NOC on the footing that the petitioner should have<br \/>\nsought for extension of period as per the previous NOC.  The matter was  taken<br \/>\nto  the  appellate  authority,  who by order dated 13.2.1997 observed that NOC<br \/>\nmust be deemed to have been  issued  as  no  order  had  been  passed  by  the<br \/>\nCollector within  the stipulated period of six months.  Accordingly, the order<br \/>\nof the Collector was set aside and the Collector was  directed  to  reconsider<br \/>\nthe matter.    Thereafter  the  Collector  issued NOC and approved the plan by<br \/>\norder dated 29.4.1999.  Thereafter  on  the  basis  of  fresh  plan,  a  fresh<br \/>\napplication  has  been  filed and the Collector by proceedings dated 15.5.2001<br \/>\napproved the plan and instructed the petitioner to complete  the  construction<br \/>\nby 28.4.2002.   The petitioner after completion of the construction, intimated<br \/>\nthe Collector by letter dated 2.1.2002 regarding such  completion  and  sought<br \/>\nfor issuance  of C Form licence.  Along with the application, the petitioner<br \/>\nhad enclosed other certificates as required.  At that stage, by  letter  dated<br \/>\n29.4.2002,  the  Collector directed the petitioner to obtain approval from the<br \/>\nTown and Country Planning authorities.  In course of time the Member Secretary<br \/>\nof the Town and Country Planning intimated that no permission can  be  granted<br \/>\nas  the  building  had  already  been completed without obtaining the required<br \/>\npermission.  There was further correspondence between the  Collector  and  the<br \/>\nMember  Secretary  of  the  Town and Country planning regarding requirement of<br \/>\nsuch permission  and  ultimately  the  Collector  had  written  to  the  Joint<br \/>\nCommissioner as well as to the Government recommending that since construction<br \/>\nof  the building had been initiated long back and building had been completed,<br \/>\nexemption may be granted.  The Collector received the communication  from  the<br \/>\nGovernment refusing to accede to the request of the Collector.  Thereafter the<br \/>\nCollector  communicated  to  the  petitioner  that no permission can be given,<br \/>\ngiving rise to the filing of the present writ petition.\n<\/p>\n<p>        3.  The contention of the petitioner is to the effect that at the time<br \/>\nwhen the petitioner  had  initially  applied  for  grant  of  permission,  the<br \/>\nprovisions  of  the  Town and Country Planning Act were not attracted and only<br \/>\nbecause of the subsequent amendment, the provisions of the  Town  and  Country<br \/>\nPlanning Act were attracted to the application for grant of permission for the<br \/>\nconstruction of  the  building  for  the  purpose of exhibiting cinema.  It is<br \/>\nfurther contended that the Member Secretary of the Town  and  Country  Planing<br \/>\nhas  refused  to  give  permission  merely  on the basis that the building had<br \/>\nalready been completed.  However, no substantial objection has been raised  to<br \/>\nthe  construction of the building or to the plan, which had been duly approved<br \/>\nby the Collector.\n<\/p>\n<p>        4.  A counter  affidavit  has  been  filed  on  behalf  of  the  first<br \/>\nrespondent indicating  various  developments  from  time to time.  It has been<br \/>\nfurther indicated that in view of the correspondence between the Collector and<br \/>\nthe Government and other authorities, no permission could be granted.\n<\/p>\n<p>        5.  Section 4  of  the  Tamil  Nadu  Cinemas  (Regulation)  Act,  1955<br \/>\nprovides  that  the  District  Collector  is  the Licensing authority to grant<br \/>\nlicence under the Act.  Section 5  provides  that  licensing  authority  while<br \/>\nconsidering  the  question  as  to  whether  licence should be granted or not,<br \/>\nshould have regard to various factors indicated in Section 5 (1)  clauses  (a)<br \/>\nto (f).    Section  5(1)(c)  relates to the suitability of the place where the<br \/>\ncinematograph exhibition is proposed to be given.  Section 5(2) provides  that<br \/>\nthe  licensing  authority  shall not grant licence unless it is satisfied that<br \/>\nthe Rules made under the Act have been substantially complied with.    Section<br \/>\n5-A empowers the licensing authority to permit construction and reconstruction<br \/>\nof buildings,  installation  of machinery, etc.  for cinematograph exhibitions<br \/>\nand sub-Section (1) provides that any person who intends to use any  site  for<br \/>\nconstructing  a  building  for exhibition of cinematograph film, or to use any<br \/>\nsite for constructing a building for exhibition of such film or  to  construct<br \/>\nor  reconstruct any building or to install any machinery at any such place, is<br \/>\nrequired to make an application to  the  licensing  authority  for  permission<br \/>\ntogether with  various  particulars  as  may  be prescribed.  Such sub-Section<br \/>\nspecifically provides that any provision contained in the  various  enactments<br \/>\nspecified shall  not  apply to any application made under Section 5-A.  As per<br \/>\nclause (vii), as it stood originally, the Town and Country Planning Act is one<br \/>\nsuch  excluded  provision  which  apparently  had  no  applicability  to   any<br \/>\napplication for  grant  of  permission  under Section 5-A.  Such provision had<br \/>\ncontinued to remain in force.  However, by Tamil Nadu Act 11 of  1994,  clause\n<\/p>\n<p>(vii) of Section 5-A(1) of the Tamil Nadu Cinemas (Regulation) Act, 1955 stood<br \/>\ndeleted.   In  other  words,  after  such deletion, the provisions of Town and<br \/>\nCountry Planning Act would be applicable even in respect of application  under<br \/>\nSection 5 of the Tamil Nadu Cinemas (Regulation) Act, 1955.\n<\/p>\n<p>        6.   In  the present case, however, the application had been initially<br \/>\nfiled in the year 1979 and permission had been granted in the year 19  82  and<br \/>\nthe building  plan  had  been  approved in the year 1983.  Subsequently, after<br \/>\ncompletion of substantial portion of the building, fresh application had  been<br \/>\nfiled,  but  the  Collector  had  rejected such application on the ground that<br \/>\nextension of time should have been sought for.  Thereafter on the basis of the<br \/>\ndirection of the  appellate  authority,  the  Collector  issued  No  Objection<br \/>\nCertificate.   Keeping  in  view the manner in which the matter had been dealt<br \/>\nwith from time to time, in the peculiar facts and circumstances,  it  must  be<br \/>\ntaken  that  in fact the grant of subsequent NOC by the Collector and approval<br \/>\nof the plan were in  continuation  of  the  earlier  sanction.    The  earlier<br \/>\nsanction  had been given at a stage when the Town and Country Planning Act was<br \/>\nnot applicable.  The subsequent Act must have been taken to be revalidation of<br \/>\nthe approved plan and in continuation of the  earlier  application  which  had<br \/>\nbeen filed  much  prior to the deletion of Clause (vii) of Section 5-A(1).  In<br \/>\nother words, even though after Tamil Nadu Act 11 of 1994 a  fresh  application<br \/>\nunder  the Act may attract the applicability of Town and Country Planning Act,<br \/>\nso far as pending applications were concerned, such Act, namely the  Town  and<br \/>\nCountry Planning Act would not be applicable.\n<\/p>\n<p>        7.  Judging the matter in the aforesaid context, it is obvious that no<br \/>\napproval  was  required from the Town and Country Planning authorities and the<br \/>\nCollector committed illegality in refusing to consider the question  of  grant<br \/>\nof C Form licence on the footing that permission has not been obtained under<br \/>\nthe Town and Country Planning Act.\n<\/p>\n<p>        8.   Alternative  contention of the petitioner to the effect that even<br \/>\nassuming that the Town and Country Planning Act is applicable, the authorities<br \/>\nunder the said Act had refused  to  grant  permission  on  mechanical  grounds<br \/>\nappears to be justified.  It is apparent from the materials on record that the<br \/>\nauthorities  under  the  Town  and  Country  Planning  had  refused  to accord<br \/>\npermission merely on the footing that the building had been  completed.    The<br \/>\nbuilding had been completed on the basis of the plan approved by the Collector<br \/>\nfrom time  to  time.   The authorities under the Town and Country Planning did<br \/>\nnot point out any substantial objection to the suitability of the site or  any<br \/>\nother relevant  aspect.  Merely because the building had been completed should<br \/>\nnot have been a ground to refuse such permission.  As a matter  of  fact,  the<br \/>\nCollector had recommended to all the authorities that compliance with the Town<br \/>\nand  Country Planning Act may not be insisted upon and necessary exemption may<br \/>\nbe granted.\n<\/p>\n<p>        9.  In the present case, since I have held that the Town  and  Country<br \/>\nPlanning Act had no application to the facts and circumstances of the case, it<br \/>\nis however unnecessary to delve further on this aspect.\n<\/p>\n<p>        10.   For  the  aforesaid  reasons,  the order passed by the Collector<br \/>\ndated 27.3.2003 is quashed and the Collector is  directed  to  reconsider  the<br \/>\nmatter regarding  issuance  of  C  Form  licence.    The  matter  should  be<br \/>\nconsidered afresh, after giving opportunity  of  hearing  to  the  petitioner,<br \/>\nwithin a  period  of  two  months  from the date of receipt of the order.  The<br \/>\nCollector may also consider the question of issuance of temporary  licence  in<br \/>\nE Form.\n<\/p>\n<p>        11.   The  writ  petition  is  accordingly  allowed,  subject  to  the<br \/>\ndirections indicated above.
