PATTANAIK (J)\n\nCITATION:\n 1996 SCC  (2)\t82\t  JT 1996 (1)\t562\n 1996 SCALE  (1)446\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Though the\t respondents have  been served,\t no  one  is<br \/>\nappearing either in person or through counsel.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     The learned  single Judge\tallowed the Writ Petition on<br \/>\nthe ground  that the  lecturers were  appointed\t on  regular<br \/>\nbasis and  satisfied the  qualifications prescribed in J &amp; K<br \/>\nMedical Education  (Gazetted)  Services\t Recruitment  Rules,<br \/>\n1979 and were appointed to time bound promotion by virtue of<br \/>\nGovernment order  No. 517-HME  of 1987 dated 19.10.1987. The<br \/>\nsaid order  indicates that  excluding the  time during which<br \/>\nthey had  worked against  ad hoc  appointment, if  they\t had<br \/>\ncompleted 7  years as  on March\t 31,  1987,  they  would  be<br \/>\ndesignated on  time bound  promotional scheme  as  Assistant<br \/>\nProfessors in  the scale of Rs. 2350-4050\/- w.e.f. 1.4.1987.<br \/>\nThe respondents\t had not  completed 7 years&#8217; regular service<br \/>\nas on  that date.  Yet learned\tsingle Judge  had given\t the<br \/>\nbenefit of  the above  G.O. There  was a  delay of  about  3<br \/>\nmonths in  filing the  appeal to  the  Division\t Bench.\t The<br \/>\nDivision Bench of the High Court was not inclined to condone<br \/>\nthe delay on the ground that proper explanation had not been<br \/>\ngiven. We  have considered  the\t reasoning  of\tthe  learned<br \/>\nJudges. On  the facts  and circumstances,  we think that the<br \/>\nexplanation given  for the  delay in  filing the  appeal  is<br \/>\nproper. It is notorious and court would take judicial notice<br \/>\nthat no\t one would  take responsibility for the delay and in<br \/>\nthe process  of leisurely  consultations  between  different<br \/>\ndepartments or\tat different  levels in\t the same department<br \/>\nthe limitation\tto file\t the appeal  gets barred. Refusal to<br \/>\ncondone the  delay feeds  public injustice and a premium for<br \/>\nlethargy and  encourages mischief.  Applying  the  pragmatic<br \/>\napproach,  the\t explanation  for  the\tdelay  needs  to  be<br \/>\nconsidered  and\t  the  cause   of   justice   advanced\t and<br \/>\nconsideration angulated\t and  accordingly,  considered\tfrom<br \/>\nthat perspective  the delay  gets condoned.  The  matter  is<br \/>\nremitted to  the High  Court for  fresh disposal  on  merits<br \/>\naccording to law.\n<\/p>\n<p>     The appeal is allowed.
