The RTI request was filed on 31.3.08.       The Appellant requested for<br \/>\n     information regarding suspension of two officials of AIR.       The CPIO<br \/>\n     replied on 29.4.08 stating that the queries related to &#8216;Third Party<br \/>\n     Information&#8217; and that the third party was contacted about disclosure<br \/>\n     of the information relating to them but they did not give their consent.<br \/>\n     Not satisfied with the reply received, the Appellant filed his first appeal<br \/>\n     on 30.4.08 reiterating his request for the information. The Appellate<br \/>\n     Authority replied on 7.7.08 stating that the RTI Act does not cast on<br \/>\n     the Public Authority any obligation to answer queries as in this case, in<br \/>\n     which a petitioner attempts to elicit answers to his questions such as<br \/>\n     Why, When, What, Whether etc.            The Appellant filed his second<br \/>\n     appeal before the CIC on 11.7.08.\n<\/p>\n<p>2.   The Bench of Mrs. Annapurna Dixit, Information Commissioner,<br \/>\n     scheduled the hearing for December 4, 2008.\n<\/p>\n<p>3.   Mr.Bhagirath Pandya, Station Director &amp; CPIO along with Mr.M.J.Peter<br \/>\n     and Mr.T.V.Pradeep represented the Public Authority.\n<\/p>\n<p> 4.    The Appellant Mr.Ravindra Parmar was present in person along with<br \/>\n      Ms.Jayashri Parmar during the hearing.\n<\/p>\n<p>Decision<\/p>\n<p>5.    The Commission noted that points 3.3 and 3.4 relate to third party<br \/>\n      information and that the CPIO had already contacted the third party<br \/>\n      who refused to give consent to disclosure of their personal files.\n<\/p>\n<p>6.    The Commission directs the CPIO to provide certified copies of the<br \/>\n      information sought by the Appellant against points No.3.1, 3.2, 3.5 &amp;<br \/>\n      3.6 in the RTI application.\n<\/p>\n<p>7.    The Commission also directs the CPIO to allow the Appellant inspect<br \/>\n      files related to points No.1 &amp; 2 of the RTI application on a mutually<br \/>\n      convenient date and provide certified copies of the information sought<br \/>\n      by the Appellant on payment of photocopying charges.\n<\/p>\n<p>8.    All information to be provided within 1 month of receipt of this Order.\n<\/p>\n<p>9.
