JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\tDate\n: 23\/09\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Mr.Dipan Desai, learned Addl.Public Prosecutor waives service of<br \/>\nnotice of rule for the respondents.\n<\/p>\n<p>\tThis<br \/>\napplication has been filed by the petitioner, who is at present<br \/>\nlodged in Vadodara Central Jail where he is serving sentence for<br \/>\noffences under the provisions of the  Narcotic Drugs and Psychotropic<br \/>\nSubstances Act, 1985.\n<\/p>\n<p>\tBay<br \/>\nway of this application dated 27-8-2008 the petitioner has prayed for<br \/>\ngrant of parole for a period of 30 days on account of the illness of<br \/>\nhis wife, who is stated to be suffering from kidney stones in both<br \/>\nthe kidneys. The petitioner has  also expressed an apprehension  that<br \/>\nhis wife may require an operation  and, therefore, his presence is<br \/>\nnecessary and the prayer made by him may be granted.\n<\/p>\n<p>\tThe<br \/>\napplication for grant of parole preffered by the applicant had been<br \/>\nrejected by the Addl.District Magistrate, Vadodara by order dated<br \/>\n5-8-2008 on the ground of adverse police opinion.\n<\/p>\n<p>\tNotice<br \/>\nwas issued on 17-9-2008. Today, when the petition is taken up<br \/>\nMr.Dipan Desai, learned Addl. Public Prosecutor has submitted a copy<br \/>\nof the report of the Police Inspector, District Mandsaur, Madhya<br \/>\nPradesh dated 22-9-2008 wherein it is stated that the wife of the<br \/>\npetitioner was admitted in the Mandsaur District Hospital on 6-5-2008<br \/>\nfor treatment and was discharged on 9-5-2008. Copies of the discharge<br \/>\nslip of the wife of the petitioner as also the Ultra Sonography<br \/>\nreport are annexed to the report. The report, as aforesaid, is taken<br \/>\non record. The report of the Police Inspector, Mandsaur also goes to<br \/>\nstate that there is an apprehension and likelihood that the<br \/>\npetitioner, who is involved in offences punishable under the Narcotic<br \/>\nDrugs and Psychotropic Substances Act may abscond, if he is released<br \/>\non parole and the police authorities of Vadodara are advised that<br \/>\nparole may not be granted to the petitioner.\n<\/p>\n<p>\tIn<br \/>\nview of the report of the Police Inspector, Mandsaur dated 22-9-08 as<br \/>\nwell as the medical report of the wife of the petitioner annexed<br \/>\nthereto, it is found that the wife of the petitioner has already been<br \/>\ndischarged after taking treatment in the month of May and it does not<br \/>\nappear that she is undergoing any treatment, as of date.\n<\/p>\n<p>\tConsidering<br \/>\nthe gravity of the offence in which the petitioner is involved and<br \/>\nthe report of the Police Inspector, District Mandsaur as well as the<br \/>\norder dated 5-8-2008 of the Addl.District Magistrate, Vadodara, the<br \/>\nprayer made in the petition cannot be granted. Accordingly, petition,<br \/>\nis dismissed.
