PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/09\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Learned APP Ms. Mini Nair waives service of rule for the<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tThe present application has been<br \/>\nfiled for grant of anticipatory bail under sec. 438 of the Code of<br \/>\nCriminal Procedure in connection with C.R. No. I-57\/2010 registered<br \/>\nwith Savli Police Station, Vadodara,  for the alleged offences under<br \/>\nsec. 307, 143, 147, 148, 149, 323, 337, 120B  of IPC and sec.<br \/>\n25(1)(D), 27 of the Arms Act and sec. 135 of the Bombay Police Act.\n<\/p>\n<p>3.\tLearned advocate Mr.  Kapadia<br \/>\nreferred to the FIR and submitted that he is not named in the FIR and<br \/>\nthe other co-accused has been granted anticipatory bail as per the<br \/>\norder passed in Criminal Misc. Application No. 9454 of 2010 dated<br \/>\n23.8.2010.  He further submitted that the applicant is only a<br \/>\ngovernment contractor and therefore considering the facts and<br \/>\ncircumstances, the present application may be allowed.\n<\/p>\n<p>4.\tLearned APP Ms. Nair  resisted<br \/>\nthe application.\n<\/p>\n<p>5.\tHaving heard learned advocate<br \/>\nMr. Kapadia and learned APP Ms. Nair and having considered the nature<br \/>\nof offence, the manner in which it is alleged to have been committed,<br \/>\nthe role attributed as well as the guidelines with regard to exercise<br \/>\nof discretion under sec. 438 of Cr.P.C.,  the present application<br \/>\ndeserves to be allowed.\n<\/p>\n<p>6.\tThe application is accordingly allowed. The applicant is ordered<br \/>\nto be released on bail in the event of his arrest in connection with<br \/>\nC.R. No. I-57\/2010 registered with Savli Police Station, Vadodara, in<br \/>\nrespect of the offence alleged against him on his executing a<br \/>\npersonal bond of Rs. 5,000\/- (Rupees Five Thousand only) each with<br \/>\none solvent surety for the like amount  and on further conditions<br \/>\nthat he shall :\n<\/p>\n<p>(a)\tremain present before the trial court regularly as and when<br \/>\ndirected on the dates fixed;\n<\/p>\n<p>(b)\tremain present at the concerned Police Station on 21.9.2010<br \/>\nbetween 11.00 am and 2.00 pm.<\/p>\n<p>(c )\tmake himself available for interrogation by the police officer<br \/>\nwhenever and wherever required.\n<\/p>\n<p>(d)\tnot directly or indirectly make any inducement, threat or promise<br \/>\nto any person acquainted with the facts of the case so as to dissuade<br \/>\nhim from disclosing such facts to the court or to any police officer;\n<\/p>\n<p>(e)\tnot to obstruct or hamper the police investigation and not to<br \/>\nplay mischief with the evidence collected or  yet to be collected by<br \/>\nthe police;\n<\/p>\n<p>(f)\tat the time of executing the bond, furnish his address to the<br \/>\nI.O. and the courts concerned, and shall not change his residence<br \/>\ntill the final disposal of the case or till further orders;\n<\/p>\n<p>(g)\tnot to leave India without the permission of the court and if<br \/>\nhaving a passport, shall deposit the same before the trial court<br \/>\nwithin a week;\n<\/p>\n<p>7.\tIt would be open to the I.O. to file an application for remand if<br \/>\nhe considers it proper and just and the learned Magistrate would<br \/>\ndecide it on merits.\n<\/p>\n<p>8.\tThis order will hold good if the applicant is arrested at any time<br \/>\nwithin 90 days from today.  The order for release on bail will remain<br \/>\noperative only for a period of 10 days from the date of his arrest<br \/>\nduring which it will be open to the applicant to make a fresh<br \/>\napplication for being enlarged on bail in usual course which, when it<br \/>\ncomes before the competent court, will be disposed of in accordance<br \/>\nwith law having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time uninfluenced by the act that<br \/>\nanticipatory bail was granted.\n<\/p>\n<p>\tRule is made absolute.
