M. SAHAI)<\/p>\n<p>1.\t\tWe have<br \/>\nheard Mr. R.D. Kinariwala, learned Advocate for Mr. D.P. Kinariwala,<br \/>\nfor the appellant and Ms. Archna N. Patel, learned Advocate for Mr.<br \/>\nHardik C. Rawal, learned Counsel for the respondent-Transport<br \/>\nCorporation.\n<\/p>\n<p>2.\t\tThe<br \/>\nappellant was a driver in State Road Transport Corporation. On<br \/>\n24.04.1992, the bus, which he was driving, met with an accident, in<br \/>\nwhich pillion rider of the cycle died. A criminal case was lodged<br \/>\nagainst the appellant, in which he was acquitted. Departmental<br \/>\ndisciplinary proceedings were initiated against him and after<br \/>\ncompletion of the departmental proceedings, withholding of three<br \/>\nincrements with future effect was imposed on the appellant.  The<br \/>\nappeal filed by the appellant was partly allowed and the punishment<br \/>\nof withholding three increments, with future effect, was reduced to<br \/>\nwithholding two increments with future effect<\/p>\n<p>3.\t\tThe<br \/>\nappellant raised an industrial dispute. The Industrial Tribunal, by<br \/>\nhis judgment dated 03.01.2005, did not interfere with the order of<br \/>\npunishment imposed by the disciplinary authority and dismissed the<br \/>\nappeal. The order of Industrial Tribunal was challenged before the<br \/>\nlearned Single Judge, which also confirmed the order of the Tribunal,<br \/>\nby judgment dated 17.06.2005.  It is this order, which has been<br \/>\nchallenged by the appellant in this appeal.\n<\/p>\n<p>4.\t\tLearned<br \/>\nCounsel for the appellant has urged that since the appellant was<br \/>\nacquitted in criminal proceedings and since, the charges and evidence<br \/>\nwere same, he could not be punished in departmental disciplinary<br \/>\nproceedings.\n<\/p>\n<p>5.\t\tWhen<br \/>\nthe charges are same and criminal and departmental proceedings are<br \/>\ngoing on together, then the question may arise as to which proceeding<br \/>\nis to continue and which one is to be stayed. The law does not<br \/>\nprovide that, if, a<br \/>\nperson has been acquitted in a criminal proceedings, departmental<br \/>\nproceedings cannot be initiated against such an employee or workman.<br \/>\nIn departmental disciplinary proceedings, the punishment of<br \/>\nwithholding three increments with future effect was imposed on the<br \/>\nappellant, which was reduced to withholding two increments, by the<br \/>\nappellate authority.  Substantial relief has been granted by the<br \/>\nappellate authority. We do not find any reason or justification to<br \/>\ninterfere with order passed by the Industrial Tribunal as well as by<br \/>\nthe learned Single Judge.\n<\/p>\n<p>6.\t\tThis<br \/>\nappeal is devoid of merit and is accordingly dismissed.
