Patna.\n                                                           ..........Petitioner\n                                            Versus\n          The State of Bihar.\n                                                              .....Opp. Party\n                                  -----------\n<\/pre>\n<p>2\/   22.07.2011             Heard.\n<\/p>\n<p>                             The Petitioner seeks bail in a case registered<\/p>\n<p>                  under Section 25 (1B) (a)\/26\/35 of the Arms Act. According<\/p>\n<p>                  to the prosecution case, one countrymade rifle and one live<\/p>\n<p>                  cartridge were seized from the possession of the petitioner.<\/p>\n<p>                             Learned counsel for the petitioner submits that as<\/p>\n<p>                  a matter of fact, no incriminating article had been seized<\/p>\n<p>                  from the possession of the petitioner and the alleged<\/p>\n<p>                  recovery was a result of transplantation. He also submits<\/p>\n<p>                  that the petitioner is in judicial custody since 22.01.2011.<\/p>\n<p>                             In the facts and circumstances of this case,<\/p>\n<p>                  particularly on the ground of the period of incarceration, the<\/p>\n<p>                  above named petitioner is directed to be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs.10,000\/-(ten thousand) with two<\/p>\n<p>                  sureties of like amount each to the satisfaction of learned<\/p>\n<p>                  Chief Judicial Magistrate, Patna, in connection with<\/p>\n<p>                  Phulwarisharif (Janipur) P.S. Case No.34 of 2011, subject to<\/p>\n<p>                  the following three conditions:\n<\/p>\n<p><span class=\"hidden_text\">                   2<\/span><\/p>\n<p>          (a) that one of the bailors must be a government<\/p>\n<p>          servant or close family member or relation of the<\/p>\n<p>          petitioner, who will file an affidavit in the court<\/p>\n<p>          below showing his\/her relationship with the<\/p>\n<p>          petitioner.\n<\/p>\n<p>          (b) If the petitioner is found involved in same and<\/p>\n<p>          similar nature of cases in future, then in that<\/p>\n<p>          cases the informant\/prosecution shall be at liberty<\/p>\n<p>          to file a petition for cancellation of the bail of the<\/p>\n<p>          petitioner, and if such a petition is filed, the court<\/p>\n<p>          below would be obliged to dispose of the same in<\/p>\n<p>          accordance with law after giving opportunity of<\/p>\n<p>          hearing to all concerned.\n<\/p>\n<p>          (c) the petitioner shall make regular pairvi in the<\/p>\n<p>          court below in the present case either by<\/p>\n<p>          appearing     himself   in    person    or   through<\/p>\n<p>          representation by his lawyer on each and every<\/p>\n<p>          date, and if on two consecutive dates petitioner<\/p>\n<p>          fails to make pairvi, then the court below shall at<\/p>\n<p>          liberty to cancel the bail bond of the petitioner.<\/p>\n<p>                            ( Birendra Prasad Verma, J )<\/p>\n<p>Anjani\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kant Paswan vs The State Of Bihar on 22 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
