Justice M.SASIDHARAN NAMBIAR\n\n Dated :12\/01\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n           CRL.M.C.No. 91   OF 2010\n          ===========================\n\n    Dated this the 12th day of January,2010\n\n                     ORDER\n<\/pre>\n<p>    This petition is filed under section 482 of<\/p>\n<p>Code of Criminal Procedure to quash Annexure A3<\/p>\n<p>order filed by the petitioner under section 10<\/p>\n<p>(3)(2) of Passport Act to impound the passport<\/p>\n<p>of the first respondent the accused.        The<\/p>\n<p>argument of the learned counsel is that the<\/p>\n<p>accused is not co-operating, eventhough the<\/p>\n<p>case has been pending for the last    two years<\/p>\n<p>and in such circumstances, learned Magistrate<\/p>\n<p>should have impounded the passport.  It is also<\/p>\n<p>submitted that in any case the findings on the<\/p>\n<p>merits of the case in Annexure 3 order is<\/p>\n<p>unwarranted and is to be quashed.<\/p>\n<p>    2.   As held by the Apex Court in <a href=\"\/doc\/572504\/\">Suresh<\/p>\n<p>Nanda v. C.B.I (AIR<\/a> 2008 SC 1414), a passport<\/p>\n<p>can be impounded only by the authority provided<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.91\/2010             2<\/span><\/p>\n<p>under the Passport Act and cannot be impounded by<\/p>\n<p>the      learned   Magistrate.     Therefore   learned<\/p>\n<p>Magistrate rightly dismissed the application. Hence<\/p>\n<p>I find no reason to interfere with Annexure 3<\/p>\n<p>order.      Though learned counsel sought to quash the<\/p>\n<p>findings in the order on merit, it is not necessary<\/p>\n<p>for this court to consider the case.
