He searched her in  the<br \/>\nvillage  and also  amongst his relatives, but he could not find out<br \/>\nthe whereabouts of his daughter and therefore he informed  the police<br \/>\nstation about the missing of his daughter. However, the Police<br \/>\nOfficer has not taken any effective steps to trace out the missing<br \/>\ndaughter of the petitioner. Therefore, the present petition  is filed<br \/>\n for the reliefs to which the reference is made in earlier paragraph<br \/>\nof the judgment.\n<\/p>\n<p>3\t\tThis<br \/>\nCourt, vide Order dated 8.9.2010,  issued Notice to the respondents,<br \/>\nwhich was made returnable  on  23.9.2010.  Thereafter the matter was<br \/>\nadjourned from time to time as the corpus could not be  traced out.\n<\/p>\n<p>4\t\tToday<br \/>\nwhen the matter is called out, Mr.  L.B. Dabhi, learned APP,  upon<br \/>\ninstructions received from Mr. R.V. Asari, Superintendent of Police,<br \/>\nKheda and Mr. S.B. Vaghela,  PSI of Limbasi Police Station, who are<br \/>\npersonally present in the Court, states that   corpus-Reshmaben<br \/>\nhas been traced out from the custody of respondent No.3- Manoj<br \/>\nBhuddabhai Rathod and they have brought  the corpus with the<br \/>\nassistance of Woman Constable of Limbasi Police Station and want to<br \/>\nproduce the corpus before the Court. Therefore, we have permitted to<br \/>\nproduce the corpus  before us.\n<\/p>\n<p>5\t\tWe<br \/>\nhave ascertained  the wish and willingness  of the corpus &#8211;<br \/>\nReshmaben and also inquired from her that as to whether she is in<br \/>\nillegal custody of  respondent No.3-Manoj Bhuddabhai Rathod.<br \/>\nShe has in unequivocal terms stated before us that her marriage with<br \/>\nthe respondent No.3  has been solemnized  on 17.9.2010 as per the<br \/>\nHindu rites and customs and since then she is residing with the<br \/>\nrespondent No.3 as his lawfully wedded wife.   She has further stated<br \/>\nthat she is very happy with the respondent No.3 Manoj Bhuddabhai<br \/>\nRathod as she is his lawfully wedded wife. She has further stated<br \/>\nbefore us that she is not under illegal detention of respondent No.3,<br \/>\nwith whom  her marriage has been solemnized on 17.9.2010 and she does<br \/>\nnot want to go to her parental home and she wants to go to her<br \/>\nmatrimonial home.\n<\/p>\n<p>6\t\tSo<br \/>\nfar as her age is concerned,  there is no dispute that her date of<br \/>\nbirth is 20.9.1991. The said fact  is not disputed  by the petitioner<br \/>\n as he has produced the xerox copy of the Birth Certificate  at<br \/>\npage-7 as Annexure-`A&#8217;  to the petition.  Therefore, there is no<br \/>\ndispute with regard to her age as her date of birth is 20.9.1991,<br \/>\nTherefore, she is major even on the day of the marriage.  Therefore,<br \/>\nshe is sui juris and, hence, no fetter can be placed upon her<br \/>\nchoice of person with whom she wants to reside.\n<\/p>\n<p>7\t\tIn<br \/>\nview of the aforesaid state of affairs, it cannot be said that the<br \/>\ncorpus-Reshmaben is in illegal  detention of respondent No.3  Manoj<br \/>\nBuddhabhai Rathod. Therefore, we have permitted her to go with<br \/>\nrespondent No.3 Manoj Buddhabhai Road.\n<\/p>\n<p>8\t\tSeen<br \/>\nin the above context,  instant Habeas Corpus petition lacks merit and<br \/>\ndeserves to be rejected.\n<\/p>\n<p>9\t\tAt<br \/>\nthis stage,  Mr. Harmish Shah, learned Advocate for Mr. B.K. Bagga,<br \/>\nlearned Advocate for the petitioner, upon instructions received from<br \/>\nthe petitioner,  does not press this petition and seeks leave to<br \/>\nwithdraw  the same.\n<\/p>\n<p>10\t\tThe<br \/>\nprayer made by him has not  been opposed by Mr. L.B. Dabhi, learned<br \/>\nAPP for the respondent No.1 State of Gujarat and Mr. D.N. Vakil,<br \/>\nlearned Advocate for the respondent Nos. 3 to 6.\n<\/p>\n<p>11\t\tHence,<br \/>\nleave to withdraw the petition is granted.  The petition  stands<br \/>\nrejected as it is withdrawn.
