Rs.3,67,,'2(\u00a7'O\/~~iitsndi\u00e9fi'the.;head'._"Vfu'ture loss of income, is

award_rnade"un'der'.*thev_ other heads is also excessive and<\/p>\n

 T\u00e9heioniy point for consideration is:\n<\/p>\n
.’:V:igfi1iether the compensation awarded by the
\nTribunal is excessive?\n<\/p>\n
 is  Ciaimant deposed as PW.1 and he has stated<\/p>\n
.’ tihat’ he sustained compound fracture of both bones of right<\/p>\n
\/’<\/p>\n
w’<\/p>\n
that, he has spent Rs.2,30,000\/- towards medical
\nexpenses, the same has been disbelieved by the Tribunal.
\nTribunal by taking into consideration Exs.P1O and P11 has<\/p>\n
awarded Rs.1,20,000\/– towards medical treatment.<\/p>\n
8. From the evidence of PW.1, it is clea_r”‘th’a;.,’__’,,iiVe;__Vit <\/p>\n
has continued the follow up treatment for about?_n\u00a7A-oiit_hszV'”  <\/p>\n
and had to suffer on account of the inj:uries’,’.,,, E’y’id,er:ce,,:_’of,,,.pi’<\/p>\n
PW.2 shows that, PW.1 needsanother”surgery_ft}r.rerho\u00a7fal”<\/p>\n
of implants from both the limo’s’;~.,’_V’the cost. ‘of’V5wh’i’ch has
\nbeen estimated at Rs.3O,;t)_’G0\/\u00bb.’_’AV  1,  l<\/p>\n
  ‘that, he was a Software<\/p>\n
Engineer inVi”MicroVVSott.’.a’t.:i.nner Ring Road, Koramangala<\/p>\n
_._and due’ to the “r\u00a7nju_ri’e,s sustained in the accident, he<\/p>\n
 g_o’A\u00aband”‘*attend his work which resulted in loss of<\/p>\n
saiar’y,an’d’e’mo’i’urrients. He has also made a claim on the<\/p>\n
–ground that there is loss of marriage prospects.<\/p>\n
it  Evidence of PW.2 discloses that, he examined<\/p>\n
  on 8.4.2005 and found that, fractures have clinically<\/p>\n

not stated that he has lost the job. In the circumstances,<\/p>\n
there could not have been any award under the head ioss<\/p>\n
of future earning capacity. The claimant is certai..ni~y<\/p>\n
entitled to loss of amenities and compensation u;{der~ _<\/p>\n
heads.\n<\/p>\n
