SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application has been preferred by the applicant &#8211;<br \/>\noriginal Opponent No.5 &#8211; The Oriental Insurance Company Limited<br \/>\nfor interim relief to stay further execution, implementation and<br \/>\noperation of the impugned judgement and award passed by Motor<br \/>\nAccident Claim Tribunal, Ahmedabad (Rural) in Motor Accident Claim<br \/>\nPetition No.93\/1999. While issuing Rule in the present application,<br \/>\nlearned Single Judge passed following order granting ad-interim<br \/>\nrelief on 22\/12\/2010 :\n<\/p>\n<p>&#8220;Rule<br \/>\nreturnable on 1st<br \/>\n February 2011.\n<\/p>\n<p>Stay<br \/>\nof the impugned award qua applicant on condition that the applicant<br \/>\nInsurance company  shall<br \/>\ndeposit 50% of its liability  as per the judgment on or before<br \/>\nreturnable date. On such deposit  being made the claimant  shall be<br \/>\npermitted to withdraw 15% of the said amount and the remaining<br \/>\namount shall be invested with<br \/>\na nationalised bank initially for a period of three years,  and on<br \/>\nmaturity  shall be renewed  by one year   at a time without any<br \/>\nfurther orders in this regard till the disposal of the appeal.   The<br \/>\nperiodical interest that may be accrued  on the said deposit shall<br \/>\nbe  paid to the original claimants. The FDR shall  be retained with<br \/>\nNazir  of the Tribunal.&#8221;\n<\/p>\n<p>3.\t\tConsidering<br \/>\nthe above and having heard learned advocates  appearing  on  behalf<br \/>\nof  the  respective parties, ad-interim relief granted earlier by<br \/>\nthis Court vide order dated 22\/12\/2010 as reproduced hereinabove, is<br \/>\nhereby directed to be continued till final disposal of the main First<br \/>\nAppeal on the same terms and conditions. Rule is made absolute<br \/>\naccordingly.
