Sessions Judge, Fast Track Court No.3, Mehsana in Sessions Case<br \/>\nNo.189 of 2004 convicting them for the offences punishable u\/s 302,<br \/>\n323 and 504 r\/w 114 of the IPC and section 135 of the Bombay Police<br \/>\nAct and sentencing them to undergo various sentences.\n<\/p>\n<p>2.\tAccording<br \/>\nto the prosecution case, there were disputes of right of way between<br \/>\nthe accused and the complainant.  Keeping grudge thereof, on<br \/>\n25.6.2004 at about 18:00 hrs. when, Vina sister of the complainant<br \/>\nJashwantji went to fetch water, accused Lakhaji and one Jitaji<br \/>\nChanduji asked her not to come to fetch water and gave abuses.<br \/>\nHence,  Jashwantji and deceased Hamirji asked them not to give<br \/>\nabuses.  Therefore, the accused got enraged and started beating Vina<br \/>\nwith kicks and fist blows.  Therefore, Jashwantji and deceased<br \/>\nHamirji intervened.  Accused Gugaji taking side of accused Lakhaji<br \/>\nbrought stick and caused injury with stick blows on the head of<br \/>\nHamirji.  On account of the head injury, Hamirji died.\n<\/p>\n<p>3.<br \/>\nOn the basis of the first information report lodged by Jashwantji,<br \/>\noffence was registered and investigation was started.  At the end of<br \/>\ninvestigation, charge sheet came to be filed against the accused for<br \/>\nthe aforesaid offences.  Jitaji Chanduji was also arrested in the<br \/>\noffence, but as he was a Juvenile, his case was transferred to the<br \/>\nJuvenile Court.  As the offence against the appellants was triable by<br \/>\nthe Sessions Court, the case was committed to the Sessions Court and<br \/>\nit was registered as Sessions Case No.189 of 2004.  The learned<br \/>\nAdditional Sessions Judge framed charge Exh-2 for the aforesaid<br \/>\noffences against the accused.  The accused pleaded not guilty to the<br \/>\ncharge and claimed to be tried.  Therefore, the prosecution adduced<br \/>\nevidence.  On completion of recording of evidence, the incriminating<br \/>\ncircumstances appearing in the evidence against the accused were<br \/>\nexplained to them.  The accused in their further statement recorded<br \/>\nunder section 313 of the Code of Criminal Procedure, 1973, stated<br \/>\nthat they are innocent.  The accused also filed written statement and<br \/>\nstated that Vina had relation with accused Lakhaji and therefore, his<br \/>\nmother had asked Vina not to come to fetch water and on the day of<br \/>\nincident, in the afternoon, there were heated exchanges between<br \/>\nVinaben and mother of accused Lakhaji.  Thereafter, in the evening,<br \/>\nJashwantji and deceased Hamirji came with sticks and Jashwantji gave<br \/>\na push with stick on the head of accused Lakhaji and deceased Hamirji<br \/>\nhit stick on the back of accused Gugaji.  Thereafter, while going to<br \/>\npolice station to lodge complaint in auto rickshaw on account of fall<br \/>\nfrom auto rickshaw, Hamirji sustained injuries and therefore, false<br \/>\ncomplaint is filed.\n<\/p>\n<p>4.\tAfter<br \/>\nhearing the learned Additional Public Prosecutor and learned advocate<br \/>\nfor the appellants accused, the trial Court recorded that the<br \/>\nprosecution has successfully proved the charge levelled against the<br \/>\naccused beyond reasonable doubt and therefore, convicted them as<br \/>\nmentioned hereinbefore.  Being aggrieved by the said decision, the<br \/>\naccused have preferred this appeal.\n<\/p>\n<p>5.\tWe<br \/>\nhave heard learned advocate Mr. Nasir Saiyed for Mr. EE Saiyed,<br \/>\nlearned advocate for the appellants and learned APP Mr. Parikh at<br \/>\nlength and in great detail.  We have also perused the impugned<br \/>\njudgment and record and proceedings of the trial Court.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate for the appellants has not disputed the incident and has<br \/>\nsubmitted that on account of grave and sudden provocation, the<br \/>\nincident occurred and there was no intention on the part of the<br \/>\naccused to commit murder of the deceased and therefore, at the most,<br \/>\nthe accused could be convicted for the offence under section 304<br \/>\n(Part II) of the IPC and therefore, the impugned judgment requires<br \/>\ninterference.\n<\/p>\n<p>7.\tAs<br \/>\nagainst this, learned APP Mr. Parikh has submitted that there is no<br \/>\nevidence that there was grave and sudden provocation, but the<br \/>\nevidence indicates that the accused with pre-determined mind attacked<br \/>\nthe deceased and caused his murder, therefore, the learned trial<br \/>\nJudge was justified in recording conviction for murder and no<br \/>\ninterference is warranted in the impugned judgment.\n<\/p>\n<p>8.\tThe<br \/>\nevidence of PW 4 Dr. Yogesh Jadav Exh-13 indicates that the external<br \/>\ninjury recorded in the postmortem note was possible by stick.  The<br \/>\npostmortem report Exh-14 indicates the external injury and cause of<br \/>\ndeath was shock and hemorrhage due to head injury.  This evidence<br \/>\nclearly indicates that the deceased died on account of head injury<br \/>\nand therefore, the death was homicidal in nature.\n<\/p>\n<p>9.\tNow<br \/>\nas regards the nature of offence, the FIR lodged by Jashwantji<br \/>\nproduced at Exh-37 indicates that there were disputes between the<br \/>\naccused and the complainant.  It also indicates that before the<br \/>\nincident, there were heated exchanges between Vina and the accused<br \/>\nand hence, the complainant and his brother Hamirji intervened,<br \/>\ntherefore, accused Gugaji Chanduji came running with the stick and<br \/>\nhit it on the head of Hamirji.\n<\/p>\n<p>10.\tThe<br \/>\nevidence of PW 5 Khodaji Gandaji Exh-16 also indicates that there was<br \/>\nscuffle and thereafter the incident ensued.  It also indicates that<br \/>\nbefore scuffle there were verbal exchanges.\n<\/p>\n<p>11.\tThe<br \/>\nevidence of PW 3 Vina also indicates that accused Lakhaji gave her<br \/>\nkicks and accused Gugaji was not present, but as Jashwantji and<br \/>\nHamirji intervened, he came there with stick and the incident<br \/>\noccurred.\n<\/p>\n<p>12.\tIn<br \/>\nview of above evidence, it clearly emerges that there was quarrel as<br \/>\nthe accused asked Vina not to take water and accused Gugaji taking<br \/>\nside of accused Lakhaji came with stick and gave one blow on the head<br \/>\nof the deceased.  It also appears that the other external injuries<br \/>\nindicated in the postmortem report were surgical wounds.  Therefore,<br \/>\ndeath was resulted on account of one blow.  The manner in which<br \/>\nincident occurred and the nature of weapon used in the offence, it<br \/>\ncannot be said that accused Gugaji with an intention to cause murder<br \/>\nof Hamirji attacked him.  Therefore, the learned trial Judge<br \/>\ncommitted error in convicting accused Gugaji for the offence of<br \/>\nmurder.  As regards conviction of accused Lakhaji for the offence u\/s<br \/>\n302 and 504 of the IPC, the evidence of PW 3 Vinaben indicates that<br \/>\naccused Lakhaji gave her kick and fist blows.  The accused have not<br \/>\nchallenged this version in the cross examination.  It also appears<br \/>\nfrom her deposition that she has not deposed about the prosecution<br \/>\ncase with regard to giving abuses.  Analyzing the evidence, it<br \/>\nappears that he did not play any role in causing death of Hamirji.<br \/>\nTherefore, the learned trial Judge committed error in convicting the<br \/>\naccused for the offence u\/s 302 and 504 of the IPC, but was justified<br \/>\nin convicting accused Lakhaji for the offence u\/s 323 of the IPC.\n<\/p>\n<p>13.\tAs<br \/>\nregards conviction u\/s 135 of the Bombay Police Act, no evidence with<br \/>\nregard to notification has been produced.  Therefore, the learned<br \/>\ntrial Judge committed error in convicting the accused for the offence<br \/>\nu\/s 135 of the Bombay Police Act.\n<\/p>\n<p>14.\tWe<br \/>\nhave heard learned advocate for the appellants and learned APP with<br \/>\nregard to sentence.  Having regard to the evidence on record and<br \/>\nfacts of the case, the conviction of accused Gugaji is required to be<br \/>\naltered from section 302 to section 304 (Part II) of the IPC and<br \/>\nconviction of accused Lakhaji u\/s 302 of the IPC is required to be<br \/>\nset aside.\n<\/p>\n<p>15.\tIn<br \/>\nview of above, in our view, the learned trial Judge committed error<br \/>\nin convicting accused  Gugaji Chanduji for the offence u\/s 323 and<br \/>\n504 of the IPC and also u\/s 135 of the Bombay Police Act and also<br \/>\ncommitted error in convicting accused Lakhaji for the offence u\/s 302<br \/>\nand 504 of the IPC and also u\/s 135 of the Bombay Police Act.\n<\/p>\n<p>16.\tIn<br \/>\nthe result, the appeal is partly allowed.  The conviction of<br \/>\nappellant accused No.1 Thakor Gugaji Chanduji recorded by judgment<br \/>\nand order  dated 21.2.2005 passed by the learned Addl. Sessions<br \/>\nJudge, Fast Track Court No.3, Mehsana in Sessions Case No. 189 of<br \/>\n2004 for the offence punishable  u\/s 302 of the IPC is altered from<br \/>\nSection 302 of the IPC to Section 304 Part-II of the IPC and is<br \/>\ndirected to undergo sentence of rigorous imprisonment for a period of<br \/>\n7 (seven) years and to pay fine of Rs.500\/-, in default thereof to<br \/>\nundergo SI for 15 (fifteen) days.  However, he is acquitted for the<br \/>\noffences u\/s 323 and 504 r\/w 114 of the IPC and also u\/s 135 of the<br \/>\nBombay Police Act.\n<\/p>\n<p>\tAs<br \/>\nregards the appellant accused No.2 Thakor Lakhaji Chanduji, his<br \/>\nconviction u\/s 302, 114 and 504 of the IPC and also u\/s 135 of the<br \/>\nBombay Police Act is set aside.
