Mann,                  Advocate,    for\n                the petitioner(s).\n\n\n                           .       .    .\n\n\nAJAI LAMBA, J (Oral)\n\n<\/pre>\n<p>                Learned counsel contends that there<\/p>\n<p>was a clerical error in the English version of<\/p>\n<p>the certificate which showed the division of the<\/p>\n<p>petitioner to be IIIrd. The Punjabi version of<\/p>\n<p>the certificate, however, indicated the Division<\/p>\n<p>of the petitioner in Matriculation to be IInd.<\/p>\n<p>                Be that as it may, learned counsel<\/p>\n<p>contends     that   it   is      not    in       dispute   that   the<\/p>\n<p>petitioner got 293 marks out of 650 marks in<\/p>\n<p>Matriculation which would constitute 45.07% (IInd<\/p>\n<p>Division).      Annexure          P-8       is     the     duplicate<\/p>\n<p>certificate which also shows that the petitioner<br \/>\n CWP No.17235 of 2009                                         [2]<\/p>\n<p>got IInd Division.\n<\/p>\n<p>                    In such circumstances, appointment<\/p>\n<p>of the petitioner as Anganwari Worker cannot be<\/p>\n<p>cancelled.          The      respondents,              however,            are<\/p>\n<p>proceeding against the petitioner for malafide<\/p>\n<p>reasons as given out in the petition.<\/p>\n<p>                    It    has     been     pointed      out         that    an<\/p>\n<p>enquiry       was      ordered        on       this    premise.            The<\/p>\n<p>proceedings have not been finalised. However, on<\/p>\n<p>account of the events and circumstances, conduct<\/p>\n<p>of the respondents discloses that the petitioner<\/p>\n<p>shall    be    removed       from      the      post    of     Anganwari<\/p>\n<p>Worker.\n<\/p>\n<p>                    This petition is disposed of with<\/p>\n<p>direction        to       the     respondents           to         consider<\/p>\n<p>certificate, Annexure P-8, before proceeding in<\/p>\n<p>the     matter      and     passing        a    final     order.           The<\/p>\n<p>respondents         are    further       directed       to         have    the<\/p>\n<p>certificate         verified      independently          from        Punjab<\/p>\n<p>School Education Board so as to ascertain true<\/p>\n<p>facts.
