Application No.1201\/09, whereby the<br \/>\n\tinterim injunction has been granted restraining the opponents<br \/>\n\ttherein from transferring or disposing the property.\n<\/p>\n<p>The<br \/>\n\tshort facts of the case appears to be that based on the arbitration<br \/>\n\taward passed on 17.01.2009 by the sole arbitrator, the proceedings<br \/>\n\twere initiated before the City Civil Court.  In the said<br \/>\n\tproceedings, the application has been submitted for interim measure.<br \/>\n\tThe City Civil Court in the impugned order has found that the amount<br \/>\n\tfor which the claim has been made deserves to be protected and<br \/>\n\ttherefore, has granted interim injunction restraining the disposal<br \/>\n\tof Bunglow No.5 of Kameshwar Twins, Near Manekbaug Octroi Naka Check<br \/>\n\tPost, Shreyas Tekra, Ambawadi, Ahmedabad till the final disposal of<br \/>\n\tCivil Misc. Application.  However, the Court did not grant<br \/>\n\tinjunction against the other properties of the opponent.  Being<br \/>\n\taggrieved with that part of the order so far as declining injunction<br \/>\n\tqua other properties of the opponent, the original applicant has<br \/>\n\tpreferred the present appeal before this Court.\n<\/p>\n<p>We<br \/>\n\thave heard Mr.Damani for the appellant and Mr.Desai for the<br \/>\n\trespondents.\n<\/p>\n<p>It<br \/>\n\tappears to us that when the interest of the appellant is<br \/>\n\tsufficiently protected by one property, the learned City Civil Judge<br \/>\n\thas rightly declined the injunction against other properties.  It<br \/>\n\tmay be recorded that the award is for Rs.40,91,737\/- with the<br \/>\n\tinterest at the rate of 18% p.a. on Rs.37,71,652.31  from the date<br \/>\n\tof the suit being Civil Suit No.3473\/98 till the payment of the<br \/>\n\tawarded amount.\n<\/p>\n<p>It<br \/>\n\twas submitted by the learned counsel for the appellant during the<br \/>\n\tcourse of the hearing that the the total amount with the accumulated<br \/>\n\tinterest would come to Rs.1.50 Crore.\n<\/p>\n<p>Even<br \/>\n\tif such submission is considered for the sake of examination, it<br \/>\n\tappears from the valuation report produced by the opponent of the<br \/>\n\tproperty in question, that the valuation is of Rs.1,71,35,000\/-.<br \/>\n\tTherefore, when the interest is sufficiently protected by the<br \/>\n\timpugned order passed by the Court below, it cannot be said that any<br \/>\n\terror has been committed in declining the injunction qua the<br \/>\n\tproperty of the respondent-original opponent.\n<\/p>\n<p>No<br \/>\n\tother contention has been raised.  In the result, the appeal is<br \/>\n\tmeritless.
