With consent of learned counsel for parties<br \/>\npetition is taken up for final disposal.\n<\/p>\n<p>3. The petitioner is aggrieved by the award of Labour<br \/>\nCourt dated 19.11.1999 in terms whereof the respondent<br \/>\nworkman was to be reinstated with full backwages and<br \/>\ncontinuity of service.\n<\/p>\n<p>4. The controversy in the present petition arises as<br \/>\nto whether respondent No. 2 workman was turned out of his job<br \/>\nor he abandoned the job. Admittedly no enquiry has been<br \/>\nheld against respondent No.2 workman.\n<\/p>\n<p>5. The Labour, Court which was dealing with the<br \/>\ncontroversy in issue observed as under:\n<\/p>\n<p>  After hearing arguments of A.R. of<br \/>\nthe parties, I find that there are two<br \/>\nways by which the services of a workman<br \/>\ncan be terminated. In the first instance<br \/>\nthe management has to comply with<br \/>\nthe provisions contained Under Section 25F of I.D.<br \/>\nAct. This  provision is not applicable to<br \/>\nthe present case. In the other case the<br \/>\nservices of a workman can be dispensed<br \/>\nwith no account of misconduct. If the<br \/>\nworkman was absent from duty as alleged<br \/>\nby the management which amounted to<br \/>\nmisconduct on his part then the management<br \/>\nwas  duty bound to hold an enquiry about<br \/>\nthe misconduct. No enquiry has been held<br \/>\nby the management as has been admitted by<br \/>\nMW1 in his cross examination where the<br \/>\nstated that no chargesheet has been<br \/>\nserved upon the workman for his absence.<br \/>\nIn absence of any enquiry the plea of<br \/>\nabandonment taken by the management<br \/>\ncannot be relied upon. So it can be<br \/>\nsafely said that the workman did not<br \/>\nabandoned the job voluntarily. There are<br \/>\nalso allegations of misconduct against the<br \/>\nworkman with regard to his use of abusive<br \/>\nlanguage in all co-workers. For that<br \/>\nalso it was obligatory on the management<br \/>\nto have held an enquiry. The management<br \/>\nhas thus failed to prove that the workman<br \/>\nhimself abandoned the job.&#8221;\n<\/p>\n<p>6. Learned counsel for the petitioner contends that in<br \/>\nview of the principles laid down by the Supreme Court in Workman<br \/>\nof Messrs Firestone Tyre &amp; Rubber Company of India (p) Ltd.<br \/>\nv. Management and Ors., , the<br \/>\nLabour Court was bound to make enquiries irrespective of the<br \/>\nfact whether an enquiry had been held or not. In this<br \/>\nbehalf learned counsel for the petitioner has relied upon<br \/>\nthe observation of the Supreme Court in aforesaid judgment<br \/>\nat page 606 as under:\n<\/p>\n<p>  &#8220;From those decision, the following<br \/>\nprinciple broadly emerge:-\n<\/p>\n<p>(4) Even if no enquiry has been held<br \/>\nby an employer or if the enquiry held by<br \/>\nhim is found to be defective, the<br \/>\nTribunal in order to satisfy itself about<br \/>\nthe legality and validity of the order,<br \/>\nhas to give an opportunity to the<br \/>\nemployer and employee to adduce evidence<br \/>\nbefore it. It is open to the employer to<br \/>\nadduce evidence for the first time<br \/>\njustifying his action; and&#8221;\n<\/p>\n<p>7. It is thus contended that in view of the plea of<br \/>\nthe petitioner that the merit of the controversy should have<br \/>\nbeen examined by the Labour Court, which has not been done<br \/>\nin the present case, the impugned award is liable to be set<br \/>\naside.\n<\/p>\n<p>8. In view of the aforesaid it is agreed by learned<br \/>\ncounsel for parties that the impugned order be set aside<br \/>\nwith a direction to Labour Court to examine the merits of<br \/>\nthe controversy raised between the parties on the basis of<br \/>\nthe evidence already on record before the Labour Court.<br \/>\nOrdered accordingly. Impugned award dated 19.11.1999 is set<br \/>\naside.\n<\/p>\n<p>9 Labour Court is directed to pass a fresh order on<br \/>\nmerits after considering the evidence on record and the same<br \/>\nbe done preferably within a period of four months.\n<\/p>\n<p>10. Writ petition stands disposed of.\n<\/p>\n<p>11.
