Government Counsel<\/p>\n<p>            Mr.     Rameshwar      Dave,    Additional   Government<\/p>\n<p>Counsel submits that a remedy of revision under Section 65 of<\/p>\n<p>the Rajasthan Stamps Act is available to the petitioner and<\/p>\n<p>without exhausting the said remedy, the writ petition filed by the<\/p>\n<p>petitioner is not maintainable.\n<\/p>\n<p>            A Constitution Bench of the Hon&#8217;ble Supreme Court,<\/p>\n<p>in G. Veerappa Pillai Vs. Raman &amp; Raman Ltd., AIR 1952 SC 192,<\/p>\n<p>held that if there is statutory remedy of appeal\/revision available<\/p>\n<p>to a person, the writ jurisdiction should not be invoked in such<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>matters. Same view has been reiterated by the Constitution<\/p>\n<p>Benches of the Hon&#8217;ble Supreme Court in K.S. Rashid &amp; Sons Vs.<\/p>\n<p>Income Tax Investigation Commission &amp; ors., AIR 1954 SC 207;<\/p>\n<p>Union of India &amp; ors. Vs. T.R. Verma, AIR 1957 SC 882; State of<\/p>\n<p>U.P. &amp; ors. Vs. Mohammed Nooh, AIR 1958 SC 86 and State of<\/p>\n<p>Madhya Pradesh &amp; Anr. Vs. Bhailal Bhai etc. etc., AIR 1964 SC<\/p>\n<p>1006.\n<\/p>\n<p>             In U.P. State Spg. Co. Ltd. Vs. R.S. Pandey, (2005) 8<\/p>\n<p>SCC 264, the Hon&#8217;ble Supreme Court held in categorical terms<\/p>\n<p>that the writ petition under Article 226 of the Constitution of<\/p>\n<p>India should not be entertained when the statutory remedy is<\/p>\n<p>available under the Act unless exceptional circumstances are<\/p>\n<p>made out.\n<\/p>\n<p>             In Uttaranchal Forest Development Corporation Vs.<\/p>\n<p>Jabar Singh, &amp; ors., (2007) 2 SCC 112,       the Hon&#8217;ble Supreme<\/p>\n<p>Court held that the High Court should not deviate from the<\/p>\n<p>general view and interfere under Article 226 of the Constitution<\/p>\n<p>except when a very strong case is made out for making a<\/p>\n<p>departure. There are several decisions to the same effect.     The<\/p>\n<p>Apex Court further held that the petitioners, who have not<\/p>\n<p>invoked the jurisdiction of the Tribunal are not entitled to any<\/p>\n<p>relief in the writ petitions.\n<\/p>\n<p>             The instant writ petition is liable to be dismissed on<\/p>\n<p>the ground that the writ petition has been filed without<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>     exhausting the alternative, efficacious and statutory remedy of<\/p>\n<p>     revision.\n<\/p>\n<p>                 The writ petition is therefore, dismissed as not<\/p>\n<p>     maintainable. However, it is open for the petitioner to challenge<\/p>\n<p>     the order impugned by way of revision.
