It was specifically<br \/>\nobserved that the plaintiff has not been able to prove that the suit<br \/>\nNal just touching the<br \/>\nsouthern walls of the property of defendants belong to plaintiff.<br \/>\nTherefore, Regular Civil Appeal No.187 of 1978 was came to be<br \/>\npreferred by the plaintiff challenging the aforesaid judgment of the<br \/>\ntrial Court. The said appeal was allowed by lower appellate Court<br \/>\nvide judgment and order dated 20th<br \/>\nNovember 1980 where on appreciation of evidence, the lower appellate<br \/>\nCourt had made observations which have been focused in para:10 and\n<\/p>\n<p>11. It was also observed on appreciation of evidence particularly the<br \/>\nCommissioner&#8217;s report that claim regarding ownership of land by the<br \/>\ndefendant has been made at later stage and on appreciation of<br \/>\nevidence, appeal was allowed. It is against this judgment, present<br \/>\nSecond Appeal has been preferred by the appellant-original defendant<br \/>\nposing the substantial question of law.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Ms.Nisha M. Thakkar for Mr.A.H.Mehta, learned<br \/>\nadvocate for the appellant and Ms.Dhara Shah, learned advocate for<br \/>\nMr.S.N.Shelat, learned senior advocate for the respondent.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and having perused paper-book<br \/>\nwhich has been supplied and on considering the material evidence on<br \/>\nrecord as it is evident that the question of law which has been posed<br \/>\nis only with regard to absence of evidence on factual aspects which<br \/>\ncannot be said to be any substantial questions of law. Therefore, as<br \/>\nthere is no substantial question of law which can be said to have<br \/>\nbeen involved, this Court, in exercise of discretion under section<br \/>\n100 of Code of Civil Procedure,  is not inclined to\u00a0interfere<br \/>\nand entertain the present appeal.\n<\/p>\n<p>5.\tIt<br \/>\nis well settled that scope of exercising discretion under section 100<br \/>\nof CPC in Second Appeal is very limited and the Court has to exercise<br \/>\nonly when there is substantial question is involved. The Hon&#8217;ble Apex<br \/>\nCourt in catena of judicial pronouncement including the judgment<br \/>\nreported in the case of (2007) 1 SCC 546 in<br \/>\nthe case of Gurdev Kaur and ors. vs. Kaki and ors<br \/>\nwherein the Hon&#8217;ble Apex<br \/>\nCourt has also observed that the amendment clearly indicates that<br \/>\nlegislature never intended Second Appeal to become third trial on<br \/>\nfacts and the High Court can interfere only when substantial<br \/>\nquestions of law are involved. Referring to scope, the guidelines<br \/>\nhave been laid down and it has been specifically observed in para-70<br \/>\nthat after the amendment in CPC in 1976, the High Court can interfere<br \/>\nunder section 100 of CPC only in case where substantial questions are<br \/>\ninvolved.  Therefore, in light of these guidelines and the<br \/>\nobservations of the Hon&#8217;ble Apex Court, as there is no substantial<br \/>\nquestions of law, which can be said to have been involved, present<br \/>\nSecond Appeal deserves to be<br \/>\ndismissed and accordingly stands dismissed.
