By interim<br \/>\norder of this Court dated 31.1.2008 certain directions were issued.<br \/>\nThe said order, reads as under :-\n<\/p>\n<p>Leave<br \/>\n\tto implead the District Registrar, Cooperative Societies, Ahmedabad<br \/>\n\t(Rural) as party respondent No.5.\n<\/p>\n<p>Heard<br \/>\n\tMr.Jani, learned Counsel appearing for the petitioners, Mr.Joshi,<br \/>\n\tlearned Counsel for respondent No.4, Mr.Shukla, learned AGP for<br \/>\n\trespondents No.1, 2, 3, and 5 upon advance copy.\n<\/p>\n<p>Prima<br \/>\n\tfacie it appears that there are serious disputes about the<br \/>\n\tmemberships of the Society and as per the petitioners, the amount<br \/>\n\thas been paid fully, the plots are allotted, but the membership<br \/>\n\trights are yet to be confirmed.  In a  housing Cooperative Society<br \/>\n\tor Cooperative Society for the joint agriculture (Samudayik), though<br \/>\n\tthere may be rights as the members, but at the same time the rights<br \/>\n\tof the allottee of the land cannot be totally ignored, unless some<br \/>\n\tdetailed inquiry is made in this regard and the election can wait<br \/>\n\tthereafter.  Further, as the appointment of custodian has been set<br \/>\n\taside and the powers are given of the Committee to the Body, against<br \/>\n\twhich there are serious allegations of manipulations of the records,<br \/>\n\tetc., it may leave room to further damage to the administration of<br \/>\n\tthe Society and, therefore, I find that until the election is<br \/>\n\tordered by this Court after the inquiry, as may be ordered<br \/>\n\thereinafter and the report is placed before this Court, the<br \/>\n\tsituation must remain under control to protect the rights of both<br \/>\n\tthe sides.\n<\/p>\n<p>As<br \/>\n\tthere is no agreement on behalf of the respondent No.4 on the name<br \/>\n\tof the officer to inquire about the affairs of the Society, I find<br \/>\n\tthat the officer of the State Government namely; District Registrar<br \/>\n\tcan be assigned such work. Since the District Registrar, Ahmedabad<br \/>\n\tCity   respondent No.3 herein had exercised the power earlier<br \/>\n\tunder Section 74D, it would be appropriate if such work of inquiry<br \/>\n\tis assigned to the other officer, who can be District Registrar,<br \/>\n\tAhmedabad (Rural)   respondent No.5 herein.  Since the District<br \/>\n\tRegistrar is even otherwise also normally supposed to be well-versed<br \/>\n\twith the administration of Societies, he would be in a position to<br \/>\n\tlook into the matter and submit the report.\n<\/p>\n<p>In<br \/>\n\tview of the above, I am inclined to pass the following order:-\n<\/p>\n<p>(a)\tRule.\n<\/p>\n<p>\t By interim order, it is directed that:-\n<\/p>\n<p>(i)\t\tRespondent<br \/>\n\tNo.5, after giving opportunity of hearing to the petitioners as well<br \/>\n\tas to respondent No.4 or the original office-bearers of Respondent<br \/>\n\tNo.4 Society, shall inquire into the following aspects and report to<br \/>\n\tthis Court:-\n<\/p>\n<p>(1)\tThe<br \/>\n\tpersons, who were original members of Savita Govind Samudayik Kheti<br \/>\n\tSahakari Mandali Limited.\n<\/p>\n<p>(2)\tThe<br \/>\n\tpersons, whose rights were created, may be by way of allotment of<br \/>\n\tthe land, after receiving the money by the aforesaid Society;\n<\/p>\n<p>(3)\tThe<br \/>\n\textent of such rights of the persons in the Society or its property<br \/>\n\tshall also be considered.\n<\/p>\n<p>(4)\tAt<br \/>\n\tthe time of conversion of  Savita Govind Samudayik Kheti Sahakari<br \/>\n\tMandali Limited to Savita Govind Cooperative  Housing Society<br \/>\n\tLimited, whether there was any change in the membership and if yes,<br \/>\n\tof what type (names and other details) ?   The list of the members<br \/>\n\tof Savita Govind Coop. Housing Society Limited shall also be<br \/>\n\texamined and considered.\n<\/p>\n<p>(5)\tIf<br \/>\n\tthere is any claim by any person after conversion of the status as<br \/>\n\tSavita Govind Coop. Housing Society Limited being the allottee of<br \/>\n\tthe plot or the land after payment and the consideration<br \/>\n\tto the Society, the same shall also be considered and the extent of<br \/>\n\tthe right of such persons in the Society and the property of the<br \/>\n\tSociety shall also be considered.\n<\/p>\n<p>(6)\tThe<br \/>\n\tchange of the revenue assessment from agriculture to<br \/>\n\tnon-agriculture, whether sanction is there and, if yes, the order of<br \/>\n\tthe competent authority.  If required, the relevant opinion or the<br \/>\n\tviews from the office of the District Collectorate may also be<br \/>\n\tcalled for and considered.\n<\/p>\n<p>(7)\tThe<br \/>\n\tdetails, if any, submitted by the office bearers of the Society or<br \/>\n\trepresentative of the Society to the revenue authority at the time<br \/>\n\twhen Savita Govind Samudayik Kheti Sahakari Mandali Limited was<br \/>\n\tthere at the time of conversion or thereafter to as Savita Govind<br \/>\n\tCoop. Housing Society Limited.\n<\/p>\n<p>(8)\tThe<br \/>\n\tconclusion of the Officer, after giving opportunity of hearing to<br \/>\n\tthe parties concerned, in respect to the rights of the petitioners<br \/>\n\tas well as the other persons into the election or the affairs of the<br \/>\n\tSociety and also the conclusion in respect to the rights of the<br \/>\n\tmembers holding share-certificates or otherwise into the election or<br \/>\n\taffairs of the Society.\n<\/p>\n<p>(9)\tIt<br \/>\n\twould be open to the petitioners as well as to the office-bearers of<br \/>\n\tthe Society to produce documentary evidence in support of their<br \/>\n\trespective claims and if required, it would also be open to the<br \/>\n\tDistrict Registrar to call upon the Society or the so-called<br \/>\n\toffice-bearers of the Society, if they are in possession of the<br \/>\n\trecord, by directing to produce the record before him for<br \/>\n\tverification of the genuineness or otherwise or in furtherance to<br \/>\n\tthe aforesaid inquiry.\n<\/p>\n<p>(ii)\tThe<br \/>\n\taforesaid process shall be completed within a period of three months<br \/>\n\tfrom the date of receipt of<br \/>\n\tthe order of this Court and the report shall be produced before this<br \/>\n\tCourt latest by 30.4.2008.  It is observed that after the report is<br \/>\n\tproduced before this Court, the matter shall be considered for<br \/>\n\tordering election of the Society concerned.\n<\/p>\n<p>(iii)\tUntil<br \/>\n\tfurther orders, the office-bearers of the Society shall not take any<br \/>\n\tdecision without prior express permission of this Court and the<br \/>\n\tstatus-quo as existing of the management of the Society shall be<br \/>\n\tmaintained.\n<\/p>\n<p>\tOffice<br \/>\n\tto supply copy of the order to Mr.Shukla, learned AGP.\n<\/p>\n<p>3.<br \/>\nIn view of the above and in view of the fact that the petitioners are<br \/>\nabsent, I am of the view that interests of justice would be met by<br \/>\ndisposing of the petition on the lines of the above interim order. It<br \/>\nis ordered accordingly. The parties  shall abide by the aforesaid<br \/>\ninterim order.
