SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\t1.<br \/>\n\t\tPresent application has been preferred by the applicant herein &#8211;<br \/>\noriginal  petitioner  for the following main reliefs:-\n<\/p>\n<p>&#8220;6(A)\t\tThe<br \/>\nHonourable Court be pleased to issue a writ of mandamus or writ in<br \/>\nnature of mandamus or any other appropriate writ, direction or order<br \/>\ndirecting the respondent authorities to release the salary of the<br \/>\npetitioner from November,2007 and to pay the salary regularly till<br \/>\nthe petitioner attains the age of 62 years pursuant to the order<br \/>\ndated 16.04.2008 passed in Application No.48 of 2007 by the Gujarat<br \/>\nAffiliated College Service Tribunal by recalling the order dated<br \/>\n02.09.2009 passed by this Hon&#8217;ble Court in S.C.A. No.8968 of 2009<br \/>\nwith S.C.A. No.4817 of 2009;\n<\/p>\n<p>(B)\t\tAlternatively,<br \/>\nthe Hon&#8217;ble Court be pleased to direct the Hon&#8217;ble Tribunal to decide<br \/>\nthe application preferred by the petitioner in accordance with law<br \/>\nand on merits in view of the order dated 02.09.2009 passed in<br \/>\nS.C.A.No.8968 of 2009 with S.C.A.No.4817 of 2009.&#8221;\n<\/p>\n<p>2.\t\tA<br \/>\ngrievance, which is voiced in this  application is that on the one<br \/>\nhand  despite the directions issued by this Court in Special Civil<br \/>\nApplication No.8968 of 2009 with Special Civil Application No.4817 of<br \/>\n2009,  vide order dtd.02\/09\/2009, the Gujarat Affiliated Colleges<br \/>\nServices Tribunal (&#8220;The Tribunal&#8221; for short)  is not<br \/>\ndeciding the main application being Application No.48 of 2007,  and<br \/>\non the other hand the applicant is without any salary and wages.\n<\/p>\n<p>3.\t\tIt<br \/>\nis the case of the applicant that while disposing of  Special Civil<br \/>\nApplication No.8968 of 2009 with Special Civil Application No.4817 of<br \/>\n2009,  this Court vide order dtd.02\/09\/2009 directed the Tribunal to<br \/>\ndecide the Application No.48 of 2007  within a period of six months,<br \/>\nhowever, the Tribunal has not only not decided the said application<br \/>\nbut on its own has extended the time to decide and dispose of the<br \/>\nsaid application, though time limit was prescribed and fixed by this<br \/>\nCourt.\n<\/p>\n<p>4.\t\tConsidering<br \/>\nthe fact that the time limit was prescribed and fixed by this Court<br \/>\nand the learned Member of the Tribunal,  on her own, could not  have<br \/>\nextended the time prescribed and fixed by this Court, to decide and<br \/>\ndispose of the aforesaid application, by order dtd.01\/10\/2010. This<br \/>\nCourt has passed the following order on 1\/10\/2010:-\n<\/p>\n<p>&#8220;Leave<br \/>\nto join the Gujarat Affiliated College Service Tribunal, Ahmedabad as<br \/>\nparty opponent no. 6.\n<\/p>\n<p>\tIt<br \/>\nis to be noted that this Court passed an order dated 02\/09\/2009 in<br \/>\nSpecial Civil Application No. 8968\/2009 directing the Tribunal to<br \/>\nfinally decide and dispose of Application No. 48\/2007 within a period<br \/>\nof six months.  From the order dated 25\/03\/2010 (Annexure &#8211; I<br \/>\nto the petition) it appears that on the ground that one another<br \/>\npetition is pending before this Court raising similar issue the<br \/>\nTribunal has not only adjourned the matter but she herself has<br \/>\nextended the period to decide and dispose of the aforesaid<br \/>\nApplication.  Once time was granted by this Court she has no business<br \/>\nand\/or jurisdiction to extend the time, which was granted by this<br \/>\nCourt.  The aforesaid conduct on the part of the Member is highly<br \/>\ndeprecated and it cannot be tolerated.  Under the circumstances,<br \/>\nRegistry is directed to call for the explanation of the concerned<br \/>\nMember of the Tribunal how she herself can extend the time to decide<br \/>\nand dispose of the Application, which was fixed by this Court in the<br \/>\naforesaid Special Civil Application.  The aforesaid explanation shall<br \/>\nbe received within a period of three weeks from today.  Stand over to<br \/>\n22\/10\/2010.&#8221;\n<\/p>\n<p>5.\t\tThat<br \/>\nthereafter the application came up for hearing on 22\/10\/2010 and it<br \/>\nwas found that despite the order dtd.01\/10\/2010 seeking explanation<br \/>\nof the learned Member of the Tribunal on or before 22\/10\/2010, the<br \/>\nlearned Member of the Tribunal did not submit her explanation to this<br \/>\nCourt as directed by this Court vide order dtd.01\/10\/2010 and,<br \/>\ntherefore, this Court passed order dtd.22\/10\/2010, which reads as<br \/>\nunder:-\n<\/p>\n<p>&#8220;It<br \/>\nis very unfortunate that despite the specific order passed by this<br \/>\nCourt dated 01\/10\/2010 seeking explanation from the learned Member of<br \/>\nthe Gujarat Affiliated College Service Tribunal, Ahmedabad and<br \/>\ndespite the fact that the said order is served upon the concerned<br \/>\nTribunal,  still no report\/explanation is received by this Court.<br \/>\nUnder the circumstances, stand over to 25\/10\/2010.  Registrar of the<br \/>\nGujarat Affiliated College Service Tribunal, Ahmedabad to remain<br \/>\npersonally present before this Court at 11:00 a.m. to explain why the<br \/>\norder passed by this Court is not complied with and the report is not<br \/>\nsubmitted till date.  Registry is directed to communicate this order<br \/>\nto the learned tribunal during the course of the day.&#8221;\n<\/p>\n<p>6.\t\tThat<br \/>\n thereafter the matter was adjourned to 25\/10\/2010 and the Registrar<br \/>\nof the Tribunal has produced on record the explanation of the learned<br \/>\nMember of the Tribunal dtd.25\/10\/2010 and further explanation<br \/>\ndtd.26\/10\/2010, by which the learned Member of the Tribunal has<br \/>\ntendered her unconditional apology  and has submitted that the next<br \/>\ndate of hearing of the Application No.48 of 2007  is fixed on<br \/>\n28\/10\/2010 and the same shall be disposed of at the earliest. She has<br \/>\nalso tendered her apology for not submitting her explanation on<br \/>\n22\/10\/2010.\n<\/p>\n<p>7.\t\tThe<br \/>\nunconditional apology tendered by the learned Member of the Tribunal<br \/>\nis accepted and the proceedings are terminated \/ dropped, however, it<br \/>\nis observed that it was not open for the learned Member of the<br \/>\nTribunal to extend the time to decide and dispose of the application<br \/>\non her own, as the time limit was prescribed and fixed by this Court.<br \/>\nIf for any reason it was not possible for the learned Tribunal to<br \/>\ndecide and dispose of the application within the time stipulated by<br \/>\nthis Court, the only way available was to either submit an<br \/>\napplication by her through Registrar of the Tribunal for extension of<br \/>\ntime and\/or the concerned party to the proceeding can submit<br \/>\nappropriate application for extension of the time limit prescribed<br \/>\nand fixed  by this Court, however, in any case, the learned member of<br \/>\nthe Tribunal has no jurisdiction to extend the time prescribed and<br \/>\nfixed  by this Court for deciding the  main application being<br \/>\nApplication No.48 of 2007. However, as unconditional apology is<br \/>\ntendered by the learned Member of the Tribunal and the next date is<br \/>\nfixed on 28\/10\/2010, the proceedings are terminated \/  dropped,<br \/>\nhowever, the learned Member of the  Tribunal is hereby directed to<br \/>\ndecide and dispose of  the main application being Application No.48<br \/>\nof 2007   as expeditiously as possible.  If for any reason the  main<br \/>\napplication being Application No.48 of 2007  is not decided and<br \/>\ndisposed of by the learned Tribunal within a period of six months<br \/>\nfrom today, it will be open for the applicant herein to file<br \/>\nappropriate  note for revival of the present application.\n<\/p>\n<p>8.\tWith<br \/>\nthese observations, the present application is disposed of.
