Kumar. 3, delivered the following\ufb01zdgrnent. \"  _ E\n1. This is the clairnantfsenhancement of\n\ncompensatioitgfor the da\ufb011age,ca.u'sed' to the building on account of a\n\nmotor vehicle acci-dgent. 0 ._ A\n\n Theiappcllantiiiwiailgegsheppa is the owner of building bearing\n\nCT 1\\Io;'*25\u00abl3i.'Wa.rdvNo. III of Hosur, Iriubli. On 09.01.2000 at about\n\n:5*.__0v0--45 i'h..oi;irs  lorry belonging to respondent no. 1 K.V.\n\n_ Allagesan driven by its driver in a rash and negligent manner dashed\n\nii~-jagainistv.hiisA\"g_'building. Lorry went inside the building of Malleshappa\n\nXV\/,\n\n\n\nLo.)\n\nand damaged the entire building. The claimant lost the rentals and\nsuffered loss in the business and also entire building needs repairs at\n\nheavy cost. In fact the lorry damaged two adjoining shOP.5__ll\n\nthe three shop owners preferred independent pet_iti'o_ns'f_c~lai1ni1;g_' I\n\ndamages. The said lorry was insured with p_ \n3. After the service of notice \ufb01rst,i'espond--ent+owner T\nremained absent. Therefore he  second\nrespondent driver was giveni_ii':'up.'l.i:ig  Insurance\n\nCompany \ufb01led a written stat:er11'ent:\" admi\u00bbtting_ theaccident, damage\n\ncaused to   coverage to the tanker in\nquestion. and negligent driving of the lorry\n the ow;ne1*shiplllor\"thVe' to the shops.\n\n    pleadings the Tribunal framed four issues. To\n\nsubstlantiiatei t'l1eii'_r.._cla;irri, the claimant Malleshappa was examined as\n\n .1 and haj\u00e9issll examined the Technical Expert Mr. Shankar Rao\n\n;.--..K.'1lilsl1naj'iii'RaoHlKadam as P.W.2. In fact Hrishikesh Sharma, another\n\n ll.'j~V.S__urveyor who estimated the damage caused to the building was\n\n\\\/\n\n\n\nexamined as P.W.3 in M.V.C. No. 333\/2000. They also produced six\ndocuments which are marked as Ex.P.] to Ex.P.6. On behalf \"of the\n\nrespondents one Hanamant Ramarao Nadiger was exa1nined\"_as\n\nand they produced 9 documents which are inarkedias   \n\nEx.R.7. V\n\n5. The Tribunal on consideration  \"afor'es_iaid._ \ndocumentary evidence on record held'--the..claimants arev_:ovvners of the'\nrespective shops. The lorry weis..driven'in' a.'i'asE;.and negligent manner\n\nby its driver which is the cause for_the' therefore it held\n\nthe claimants have negligence. Thereafter in\nassessing the damage'  of the evidence of Shankarrao\nKrishnaji Kadan: has assessed damages on the basis of the\n\nannual' income of ea-cvh of petitioner from their respective shops at Rs.\n\n  l,80,il000i;*~.,and ilcaineigitoii the conclusion that each one of them will get\n\n iiif\ufb01ve years and there is net loss of \"Rs. 17,03,453\/--\n\n'rdediucting 33% of taxes, maintenance charges. The Technician\n\n V-Sharina who made preliminary survey of the building of\n\n\n\nMalleshappa and noticed visible damage of rolling shutters, brick\nworks, R.C.C. Colum, front Pardi. According to him to restore the\n\nshop to its normal condition a sum of Rs. l,02,000\/-- is reqtlired.\n\nFurther, he has estimated the loss at Rs. 24,000\/- by \n\nshop for four months at the rental rate of Rs. 4,000\/:__ya'e--r.Vrnonth  _ \n\nthen total loss of rental revenue for 15 years as j.2O--;,7O4,_()0..0'\/'~.. \n\nloss of Rs. 15,45,000\/--. They were cros.s_Vexamined.V  * it i\n\n6. The Tribunal on cons,ideration\"mof ..tl1ei\"aforesaid\"'evidence on\n\nrecord held the photographs proiduced' i'v'.Vi(i)Lll(Ii'_:S:i*i:{)Ai'_L\":\u00ab'.Vi1iiZi1.\u00a7e damage caused\n\nto the    are exaggerating, the\nclaimants haye 'rent documents and income tax\nreturns to  the the business and also not produced\n Show tihatlshop was not let out on rental after the\n\naccid'ent;'l'.___Sio'~,4=.il'so_ clliairhant has not produced any document to show\n\nthey costiiiof  of the building whEch they have undertaken.\n\n.: 'V..Sirni\u00bb1arly--t,here is no evEden_ce to show the loss of future income due to\n\n  caused to the shops. \n\n\n\n7. Therefore looking at the damage and the report of the exports\nthe Tribunal was of the View that each of the claimants has sustained\n\ndamage of Rs. 1,00,000\/- per shop. Therefore the Tribunal a\n\nsum of Rs. 1,00,000\/- with interest at 6% pa. frornjitheaiisdalte \n\npetitions till realisation.\n\n8. Aggrieved by the said judgrnentout of  three:.c;lairnanits.lionly \n\nMalleshappa has preferred this appelalgl' Learncdlpi\"coiuns'el 'tor the\nappellant assailing the  Vi\"aaw_ard\u00ab.contends that the\n\nTechnical Experts havegiven eviciehce -statin\u00e9\"thatlthe loss on account\n\nof the accidenltllislitohfthell Rs.l._lll9l,i(ii)0,000\/~ to Rs. 20,00,000\/..\nbut the Tribunal was' \"in awarding only a sum of Rs.\n\n1,00,000\/-- ; aiidptheirefore' he lsubimitted a need for an interference is\nll-1'lei:':coritra,..lvearned counsel for respondent no. 3 supported the\n\n v  impugmid-.award;v\u00bb -- ..  V ' it .\n\n\n\n10. From the material on record it is clear the claimant is the owner\nof a shop. The said shop got seriously damaged on account of gas\ntanker ploughing into the shop. The photographs are produced to\n\nshow the extent of damage. The evidence on record \n\nwere 32 years old. According to experts it had anotherpilife  K  \n\nyears. However in order to claim damages fot\ufb01the darr'iag'e_ cau.seid,on'\n\naccount of the accident Sri S.K. Kgadam hadV_iadoptedl'i'\n\ncaiculating the rental income for remaining 15 ' years which the\nclaimants would have got if th'eiaccidger:{.t ihadijnoptitaken place and on\nthat basis he has given his report' idathiage is to the extent\n\nof Rs. 17,03;453;'~'.   has given his report that the\nrental income  deducting tax and maintenance\ncharges lieii'\u00a2~hasV:es.timated'th-e*net toss at Rs. 15,45,000\/-. This is the\n\nbasisfor tire claimant. Both of them have failed to notice,\n\nif the building. isiifeconstructed not only the claimant would get the\n\n.. present market \u00abrent and continue to get rent for 15 years. That is not\n\n   't-oassess the damage caused to the building. It is not the case\n\n  V  y _ it  the shop being acquired by an acquiring authority depriving right\n\nit,\n\n\n\nand title of the property to the owner. This is a case where because of\nthe accident building is collapsed. Therefore in order to assess the\n\ndamage they are expected to take into account the age of the building,\n\ndepreciation which is legally permissible and then arrive \n\nconstruction. Sri H.K. Shanna has made an attemptthis\ufb02idirectiion  i \n\nand according to him Rs. 1,02,000\/-- is siif\ufb01ciient to \n\nbuilding to its original position.
