MUKHOPADHAYA)<\/p>\n<p>\t\tThe<br \/>\npetitioners are the original plaintiffs who instituted Regular Civil<br \/>\nSuit No. 196 of 2006 for a declaration that they are owners and in<br \/>\npossession of the land bearing Revenue Survey Nos. 218, 326, 331, 457<br \/>\nadmeasuring 0-33-39, 014-16, 0-63-74 and 0-01-01 Hectare, Are and Sq.<br \/>\nmtrs. respectively situated at village Amodar, Ta: Vaghodia, Dist:<br \/>\nVadodara. In the said case, the trial court passed an interim order<br \/>\nof status quo which was vacated by the appellate court by judgment<br \/>\nand order dated 18th March, 2009 at the instance of the<br \/>\ndefendants-respondents. Learned Single Judge having affirmed the<br \/>\norder passed by the appellate court, the present Appeal under Clause<br \/>\n15 of the Letters Patent has been preferred.\n<\/p>\n<p>\t\tLearned<br \/>\ncounsel appearing on behalf of the petitioners submitted that there<br \/>\nis another proceeding pending between the parties before Gujarat<br \/>\nRevenue Tribunal wherein the order of status quo was directed to be<br \/>\nmaintained which the trial court, taking into consideration the<br \/>\naforesaid facts, has passed the order of status quo and therefore, it<br \/>\nshould not have been interfered with by the appellate court.\n<\/p>\n<p>2.\t\tFrom<br \/>\nthe judgment, we find that the learned Single Judge, on perusal of<br \/>\nthe record gave the following findings.\n<\/p>\n<p>(a)<br \/>\n\tThere is no material on record to show that the petitioners \tare \tin<br \/>\nactual possession of the suit land.\n<\/p>\n<p>(b)<br \/>\n \tThe names of the petitioners do not find mention in the \trecord of<br \/>\nrights. On the contrary, the name of the  \tpredecessor-in-interest of<br \/>\nthe respondent is reflected in the \trevenue record since 1980 to<br \/>\n1981.\n<\/p>\n<p>(c)<br \/>\n  The trial court has not given any conclusive independent \tfinding<br \/>\nof fact regarding possession of the petitioner.\n<\/p>\n<p>\t\tTaking<br \/>\ninto consideration the aforesaid fact and the fact that the State of<br \/>\nGujarat has not been impleaded as party-defendant in the suit as<br \/>\nthere are mutation entries in favour of the State, learned Single<br \/>\nJudge refused to interfere with the order passed by the appellate<br \/>\ncourt.\n<\/p>\n<p>3.\t\tWe<br \/>\nfind no ground made out to interfere with the said order.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel appearing on behalf of the  petitioners submits that in the<br \/>\npending matter, status quo order passed by the Gujarat Revenue<br \/>\nTribunal is still in existence. The order passed by the Appellate<br \/>\nCourt or Civil Court may affect the same.   In this connection, we<br \/>\nmay only mention that the order of Tribunal not being under challenge<br \/>\neither before this Court or before Civil Court, it cannot be stated<br \/>\nthat the Court has expressed any opinion with regard to the order<br \/>\npassed by the Tribunal. There being no merit, the Appeal  and Civil<br \/>\nApplication both are dismissed.
