Singh, AC to G.P. 15.\n<\/p>\n<p>                                    &#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>2.   04.04.2011               Heard learned counsel for the petitioner<\/p>\n<p>                  for the State and for the State Election Commission.<\/p>\n<p>                              The petitioner is stated to be the Mukhiya<\/p>\n<p>                  of the Dakhram Gram Panchayat at Darbhanga.<\/p>\n<p>                              Learned counsel submits that it is one of<\/p>\n<p>                  the 22 Gram Panchayats which were amalgamated<\/p>\n<p>                  for creation of the Benipur Nagar Parishad. A part of<\/p>\n<p>                  the Dakhram Gram Panchayat however was left out<\/p>\n<p>                  consisting of a population of at least 1393 and which<\/p>\n<p>                  is the bone of contention in the present writ<\/p>\n<p>                  application. It is submitted that the creation of the<\/p>\n<p>                  Benipur Nagar Parishad by amalgamation of the<\/p>\n<p>                  Panchayats was itself not in accordance with law<\/p>\n<p>                  and therefore the bifurcation of the Dakhram Gram<\/p>\n<p>                  Panchayat excluding 1393 persons was itself not in<\/p>\n<p>                  accordance with law.      There had been no proper<\/p>\n<p>                  notifications under the Bihar Panchayat Raj Act and<\/p>\n<p>                  the Rules with regard to the territorial constituencies<\/p>\n<p>                  by publication in accordance with Rule-8. It is next<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>submitted that Sajjanpur Gram Panchayat with<\/p>\n<p>which this 1393 population of Dakhram Gram<\/p>\n<p>Panchayat has been amalgamated is a reserved<\/p>\n<p>constituency which may affect the electoral prospect<\/p>\n<p>of a person from the Dakhram Gram Panchayat.<\/p>\n<p>            Learned counsel for the State Election<\/p>\n<p>Commission from its order dated 10.2.2011 submits<\/p>\n<p>that the authorities keeping in mind the interest of<\/p>\n<p>this 1393 population of Dakhram Gram Panchayat<\/p>\n<p>decided to merge it with the Sajjanpur Gram<\/p>\n<p>Panchayat    for   reasons   of   convenience   of   the<\/p>\n<p>electorate as discussed in the order for geographical<\/p>\n<p>reasons.\n<\/p>\n<p>            It is not the case of the petitioner that<\/p>\n<p>none of these 1393 electorate belonged to the<\/p>\n<p>reserved category and are therefore ineligible to<\/p>\n<p>participate in the Panchayat elections through the<\/p>\n<p>Sajjanpur Panchayat.     In any event of the matter,<\/p>\n<p>whether the bifurcation of the Dakhram Gram<\/p>\n<p>Panchayat or any other Panchayat for creation of the<\/p>\n<p>Benipur Gram Panchayat was in accordance with<\/p>\n<p>law having its fall out on the present Dakhram<\/p>\n<p>Panchayat and its amalgamation with Sajjanpur etc.<\/p>\n<p>are matters clearly beyond the purview of this Court<\/p>\n<p>in view of the interim order passed in L.P.A. No.<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>           1797 of 2010, staying the operation of the order in<\/p>\n<p>           C.W.J.C. No. 1297 of 2010. Suffice it to notice that<\/p>\n<p>           in the writ petition, the creation of the Benipur<\/p>\n<p>           Nagar Parishad had been set aside.     The status of<\/p>\n<p>           the Benipur Nagar Parishad having been revived<\/p>\n<p>           under the interim order of the Appellate Court, this<\/p>\n<p>           Court finds no reason to interfere in the present writ<\/p>\n<p>           application. The Court is satisfied that by the<\/p>\n<p>           impugned order of the State Election Commission<\/p>\n<p>           the electorate at large of the Dakhram Gram<\/p>\n<p>           Panchayat amalgamated with Sajjanpur has been<\/p>\n<p>           given adequate and equal opportunity not only to<\/p>\n<p>           contest Panchayat Elections, if so advised, but also<\/p>\n<p>           to exercise their right of franchise with which the<\/p>\n<p>           Court is not inclined to interfere at the behest of an<\/p>\n<p>           individual whose own political prospect may get<\/p>\n<p>           jeopardized in the process.\n<\/p>\n<p>                      The writ application stands dismissed.<\/p>\n<pre>P.
