While passing the order of detention the detaining<br \/>\nauthority has mainly considered the fact of registration of a single<br \/>\noffence punishable under Sections 66B, 65AE, 81,of the Bombay<br \/>\nProhibition Act registered as CR no.III-26\/2008 and the statement of<br \/>\nthe accused in the prohibition case.\n<\/p>\n<p>4.\tThe<br \/>\nlearned Advocate for the petitioner-detenu has assailed the order<br \/>\nunder challenge on various grounds. However,this petition is capable<br \/>\nof being disposed of on the sole ground as to whether there was<br \/>\ncredible material placed before the detaining authority to come to<br \/>\nthe conclusion that by the activities of the petitioner, public order<br \/>\nwas disturbed or that public health was disturbed adversely.\n<\/p>\n<p>5.\tTo<br \/>\nreach to the subjective satisfaction that bootlegging activities of<br \/>\nthe petitioner were prejudicial to the maintenance of public order<br \/>\nand public health, the detaining authority must rely upon credible<br \/>\nand cogent material that the activities of the petitioner directly or<br \/>\nindirectly were causing or were likely to cause any harm danger or<br \/>\nalarm or feeling of insecurity among the general public or any<br \/>\nsection thereof or a grave or widespread danger to life, property or<br \/>\nthe public health. While undertaking this exercise, the detaining<br \/>\nauthority must draw a clear line between the cases falling within<br \/>\nbreach of law and order and breach of public order.\n<\/p>\n<p>6.\tThe<br \/>\nfacts of the present case are squarely covered by a decision of the<br \/>\nApex Court in the matter of Darpan @ <a href=\"\/doc\/1753534\/\">Dharban Kumar Sharma vs.<br \/>\nState of Tamil Nadu and Ors.<\/a> (2003) 2 SCC 313 wherein while<br \/>\ndealing with solitary instance of robbery as ground for preventive<br \/>\ndetention, the Apex Court observed that there is nothing on record to<br \/>\nshow that the reach and potentiality of the incident was so grave as<br \/>\nto disturb the even tempo of life of the community in the locality or<br \/>\ndisturb general peace and tranquility or create a sense of alarm and<br \/>\ninsecurity in the locality. Solitary instance of robbery was held not<br \/>\nrelevant for sustaining the order of detention and that such incident<br \/>\ncould hardly be said to disturb public peace or public order in<br \/>\njeopardy so as to bring the case within the purview of preventive<br \/>\ndetention.\n<\/p>\n<p>7.\tIn<br \/>\nthe present case, the detaining authority has taken into<br \/>\nconsideration the investigation papers in solitary case registered<br \/>\nagainst the petitioner under the Bombay Prohibition Act. This case is<br \/>\nregistered against the petitioner as he was found in possession of<br \/>\n344 bottles of prohibited foreign liquor and that he was engaged in<br \/>\nthe business of transporting and selling  foreign liquor in breach of<br \/>\nlaw for which the petitioner can be adequately punished if found<br \/>\nguilty. Surely,the act constituting the offence cannot be said to<br \/>\nhave affected the even tempo of life of the community. It is<br \/>\ntherefore difficult for this Court to accept that the petitioner has<br \/>\nbeen rightly detained as the activities of the petitioner can at the<br \/>\nmost be termed as affecting law and order. In short, no further<br \/>\ndiscussion on the other points raised in this petition is required as<br \/>\nin the opinion of this Court, the order of detention is not<br \/>\nsustainable in the eye of law as the subjective satisfaction arrived<br \/>\nat by the detaining authority is  not legal and valid. The order<br \/>\nunder challenge is required to be quashed and set aside on this<br \/>\nground alone.\n<\/p>\n<p>8.\tIn<br \/>\nthe result, the petition is allowed. The impugned order of detention<br \/>\ndated 25.3.2008 passed by the Police Commissioner,Vadodara City, is<br \/>\nhereby quashed and set aside and detenu is hereby ordered to be set<br \/>\nat liberty forthwith, if not required to be detained in any other<br \/>\ncase. Rule is made absolute.
