Justice S.S.SATHEESACHANDRAN\n\n Dated :01\/07\/2010\n\n O R D E R\n         THOTTATHIL B.RADHAKRISHNAN\n          &amp; S.S.SATHEESACHANDRAN, JJ.\n         ---------------------------------------\n             C.M.Appln No.1020 of 2010\n                &amp; F.A.O.No.161 of 2010\n         ---------------------------------------\n        Dated this the 1st day of July, 2010\n\n                      JUDGMENT\n<\/pre>\n<p>THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>          Plaintiffs, in a suit for recovery of money,<\/p>\n<p>are the appellants. The suit was dismissed for default.<\/p>\n<p>An application for restoration, with an application to<\/p>\n<p>condone delay was filed.       Thereafter, when those<\/p>\n<p>applications were taken up, there was no appearance<\/p>\n<p>for the plaintiffs.      Accordingly, that was also<\/p>\n<p>dismissed. The plaintiffs have filed this appeal against<\/p>\n<p>those orders with an application to condone delay of<\/p>\n<p>92 days in instituting this appeal.<\/p>\n<p>          2.     Though the plaintiffs attribute the<\/p>\n<p>reason for lack of appearance before the court below<\/p>\n<p>to the inability of their counsel to appear on that day<\/p>\n<p>owing to his hospitalisation, we are clear in our mind<\/p>\n<p>that an application for restoration, when dismissed for<\/p>\n<p>F.A.O.No.161 of 2010<\/p>\n<p>                             :: 2 ::\n<\/p>\n<p>default, can be sought to be restored invoking Order IX<\/p>\n<p>Rule 9, read with Section 141 of the Code of Civil<\/p>\n<p>Procedure, if needed with a petition under Section 5 of<\/p>\n<p>the Limitation Act.\n<\/p>\n<p>          Under such circumstances, we do not deem it<\/p>\n<p>necessary to entertain this C.M. Application and FAO.<\/p>\n<p>Without prejudice to the right of the appellants to file an<\/p>\n<p>application in terms of Order IX Rule 9 read with Section<\/p>\n<p>141 of the Code of Civil Procedure along with a petition<\/p>\n<p>under Section 5 of the Limitation Act, in accordance with<\/p>\n<p>law, before the court below, this C.M.
