DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tHeard<br \/>\nlearned advocates appearing for the parties.\n<\/p>\n<p>2.\tMr.\n<\/p>\n<p>Tejas Barot, learned advocate for the applicant submits that name of<br \/>\nthe applicant is reflected during course of the investigation,  since<br \/>\nname of the applicant was not mentioned in the FIR and no role was<br \/>\nattributed.  It is further submitted that what is alleged against the<br \/>\napplicant is that he had accompanied accused named in the FIR at<br \/>\nvarious places and introduced the persons to enter into the<br \/>\ntransaction.  The applicant herein is serving in the ONGC and at the<br \/>\nmost the next allegation is to the extent that while investigation<br \/>\nwas on, the applicant had arranged the meeting to resolve the dispute<br \/>\nbetween the parties and it is considered as involvement of the<br \/>\napplicant in commission of the crime.  The above approach of the<br \/>\ninvestigating authority in a case of sale deed registered on<br \/>\ndifferent dates which were not signed or in any manner executed by<br \/>\nthe applicant, for which, he is not to face any harassment and,<br \/>\ntherefore, the impugned complaint to be stayed.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the complainant and learned APP for the State has<br \/>\nopposed grant of any relief to the applicant on the ground that the<br \/>\napplicant is the person who has arranged all transactions and played<br \/>\nimportant role and his involvement vis-a-vis the offences is under<br \/>\ninvestigation.  Besides, statements recorded by a clerk of the notary<br \/>\nwould reveal that the applicant herein had accompanied other accused<br \/>\nat the time of notarization of the documents.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsels for the parties, considering the facts and<br \/>\ncircumstances of the case and recital of the sale deed, it reveals<br \/>\nthat amount in question with regard to consideration was paid by<br \/>\ncheques and dates on which the amount was paid is also mentioned.<br \/>\nAll three documents namely sale deeds do not reflect name of the<br \/>\napplicant as a signatory in any capacity.  Besides, till today no<br \/>\naction of civil nature is taken over to cancel the power of attorney,<br \/>\nsale deed etc. even with regard to the accused named in the FIR.<br \/>\nPrima facie, statements have been recorded about presence of the<br \/>\napplicant at various places including the office of Talati or before<br \/>\nthe Notary by itself cannot be said to be involvement in any of the<br \/>\ncrime.   Besides, the transaction appears to be of a civil nature, I<br \/>\ndeem it just and proper to stay further investigation qua the<br \/>\napplicant herein only and is stayed accordingly.\n<\/p>\n<p>5.\tIn<br \/>\nview the above, matter deserves consideration.  Hence, Rule<br \/>\nreturnable on 6th April, 2011.  Mr. P.\n<\/p>\n<p>S.
