        Petitioner   was   an   employee   of   the   Food   Corporation   of<\/p>\n
India.   He   retired   from   service   as   Assistant   Manager   (Quality<\/p>\n
Control)   of   the   Food   Corporation   of   India   on   2.12.2004.\n<\/p>\n
Employees   Family   Pension   Scheme   was   introduced   in   FCI   in<\/p>\n
1996. The details of the employees pension scheme is contained<\/p>\n
in Ext.P1. It is admitted that   the petitioner is a member of the<\/p>\n
employees   pension   scheme,   which   is   a   contributory   pension<\/p>\n
scheme. Payment of contribution is as per clause – iii of Ext.P1.\n<\/p>\n
Petitioner  has eligible service and is entitled to get pension. His<\/p>\n
grievance is that necessary returns are not forwarded to the first<\/p>\n
respondent,   the   Regional   Provident   Fund   Commissioner   and<\/p>\n
therefore the pension is yet to be disbursed to him.\n<\/p>\n
      2.   Mr.   Jacob   Varghese,   learned   standing   counsel   for   the<\/p>\n
Food   corporation   of   India,   on   instructions,   submits   that   he   has<\/p>\n
already instructed the competent authority to forward the annual<\/p>\n
return, in relation  to the petitioner and     needful  shall  be done<\/p>\n

without   any   further   delay.   Standing   counsel   for   the   first<\/p>\n
respondent Smt.Girija submits that immediately on receipt of the<\/p>\n
annual return from the FCI, steps will  be taken to disburse the<\/p>\n
pension due and admissible to the petitioner. These submissions<\/p>\n
are recorded.\n<\/p>\n
      3. In the circumstances, the writ petition   is disposed of in<\/p>\n
the following terms:\n<\/p>\n
      1) Annual return, relating to the petitioner, for the purpose<\/p>\n
of   Employees   Pension   Scheme,   shall   be   forwarded   by   the<\/p>\n
concerned District Manager of the Food Corporation of India , as<\/p>\n
expeditiously   as   possible,   at   any   rate,   within   a   period   of   one<\/p>\n
month from the date of receipt of a copy of this judgment, to the<\/p>\n
first respondent – Regional Provident Fund Commissioner.\n<\/p>\n
      2)   Immediately   on   receipt   of   the   said   annual   return   from<\/p>\n
the District Manager  of the Food Corporation of India, the first<\/p>\n
respondent- Regional Provident Fund Commissioner  shall  verify<\/p>\n
the   eligibility   of   the   petitioner   in   relation   thereto   and   then<\/p>\n
proceed to disburse  pension due and admissible to him, within a<\/p>\n
period of one month thereafter. It is made clear that if there is<\/p>\n
delay   in     forwarding   of   the   annual   return,   then   the   Food<\/p>\n

Corporation of India will  be made liable for payment of interest<\/p>\n
for   the   amount   due   to   the   petitioner,   after   the   period   of   one<\/p>\n
month   as   mentioned   above.   Similarly,   if   there   is   delay   in   the<\/p>\n
disbursal of pension due to the petitioner, after receiving of the<\/p>\n
annual return, first respondent will also liable to pay interest to<\/p>\n
the petitioner for the delayed payment.\n<\/p>\n
