SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/10\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the impugned order dated 29\/07\/2000 passed<br \/>\nby the Additional Registrar in Appeal No. 102\/1999 and the order<br \/>\ndated 31\/08\/2000 passed by the Deputy Secretary in Revision<br \/>\nApplication No. 140\/2000 rejecting the registration granted to the<br \/>\npetitioner-Society.\n<\/p>\n<p>2.\tThe<br \/>\nfacts leading to the present Special Civil Application in a nutshell<br \/>\nare as under;\n<\/p>\n<p>3.\tThe<br \/>\npetitioner-Society was registered under the provisions of the Gujarat<br \/>\nCo-operative Societies Act by the Agricultural Production Cooperation<br \/>\nand Irrigation Committee of the District Panchayat, Banaskantha vide<br \/>\nResolution No. 4 dated 13\/05\/1999 and the same was challenged by<br \/>\nrespondent no. 3 before the Additional Registrar (Co-operative<br \/>\nSociety) by way of Appeal No. 102\/1999 and by impugned order dated<br \/>\n29\/07\/2000 the appellate authority allowed the said Appeal and<br \/>\nquashed and set aside Resolution No. 4 dated 13\/05\/1999 of<br \/>\nAgricultural Production Cooperation and Irrigation Committee of the<br \/>\nDistrict Panchayat, Banaskantha and cancelled the registration, which<br \/>\nwas in favour of the petitioner.  Being aggrieved and dissatisfied<br \/>\nwith the order passed by the Additional Registrar (Co-operative<br \/>\nSociety) (Appeals), the petitioner preferred Revision Application<br \/>\nbefore the State Government, which came to be dismissed  by the<br \/>\nDeputy Secretary  by impugned order dated 31\/08\/2000 in Revision<br \/>\nApplication No. 140\/2000.  Being aggrieved and dissatisfied with the<br \/>\nimpugned orders, the petitioner has preferred the present Special<br \/>\nCivil Application under Articles 226 and 227 of the Constitution of<br \/>\nIndia.\n<\/p>\n<p>4.\tAfter<br \/>\nthe matter was argued for some time by the learned advocates<br \/>\nappearing on behalf of the respective parties, there is a broad<br \/>\nconsensus between the learned advocates appearing on behalf of the<br \/>\nrespective parties, under instructions from their respective clients,<br \/>\nthat let the impugned orders be quashed and set aside and the matter<br \/>\nbe remanded to the Committee for deciding the application of the<br \/>\npetitioner for registration under the Gujarat Co-operative Societies<br \/>\nAct afresh in accordance with law and on its on merits and after<br \/>\ngiving an opportunity to all the concerned, inclusive of respondent<br \/>\nno. 3 and to take an appropriate decision after considering the<br \/>\nobjections that may be raised by respondent no. 3 and take into<br \/>\nconsideration  whether by registering the petitioner under the<br \/>\nGujarat Co-operative Societies Act, whether respondent no. 3 and\/or<br \/>\nany other Society is likely to be affected or not.  The learned<br \/>\nadvocates appearing on behalf of the respective parties do not invite<br \/>\nany further reasoned order while quashing and setting aside the<br \/>\nimpugned orders and remanding the matter  to the appellate authority.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above broad consensus between the learned advocates<br \/>\nappearing on behalf of the respective parties and without expressing<br \/>\nanything on merits in favour of either parties, the impugned orders<br \/>\npassed by the Additional Registrar (Co-operative Society) (Appeals)<br \/>\ndated 29\/07\/2000 in Appeal No. 102\/1999 as well as the revisional<br \/>\nauthority  dated 31\/08\/2000 in Revision Application No. 140\/2000  are<br \/>\nhereby quashed and set aside and Resolution No. 4 dated 13\/05\/1999 of<br \/>\nthe Agricultural Production Cooperation and Irrigation Committee of<br \/>\nthe District Panchayat, Banaskantha  is  also quashed and set aside<br \/>\nand the matter is remanded to the Agricultural Production Cooperation<br \/>\nand Irrigation Committee of the District Panchayat, Banaskantha to<br \/>\ntake an appropriate decision in accordance with law and on its own<br \/>\nmerits on the proposal of the petitioner-Society to register it under<br \/>\nthe provisions of the Gujarat Co-operative Societies Act after giving<br \/>\nan opportunity to the petitioner as well as respondent no. 3 and<br \/>\nAgricultural Production Cooperation and Irrigation Committee of the<br \/>\nDistrict Panchayat, Banaskantha to take an appropriate decision in<br \/>\naccordance with law and on its own merits considering the objections<br \/>\nthat may be raised by respondent  no. 3 and considering whether by<br \/>\nregistering the petitioner under the Gujarat Co-operative Societies<br \/>\nAct, respondent no. 3 is likely to be affected or not.  The aforesaid<br \/>\nexercise shall be completed within a period of six months from the<br \/>\ndate of receipt of the present order.  Rule is made absolute to the<br \/>\naforesaid extent.
