JTJDC52-MEIQT  AWARD DATED\n\n23.1\u00a7;\u00e9001 so As IO DNHANOE THE AWARD AMOUNT.\n\nIHIS ABEEALSCONING ON FOR HEARING THIS DAY,\nTHE count DELIVERED THE FOLLOWING:\n\nJUDGMENT\n<\/pre>\n<p>ifhisFappeal is directed against the judgment<\/p>\n<p>S= and &#8220;awatdfadated 23.10.2007 in MVC No.17o\/2006<\/p>\n<p>pa$sed&#8217;b\u00a79the MACT at Bidar.\n<\/p>\n<p>\u00e9. The only grievance of the appellants is<\/p>\n<p>&#8220;t\u00a2h$t the compensation awarded under the head loss<\/p>\n<p>&#8220;of dependency is On the lower side. It is not in<\/p>\n<p>dispute that the deceased was 11 years old on the<\/p>\n<p>date of accident. It is settled position of law<\/p>\n<p><span class=\"hidden_text\">-3-<\/span><br \/>\nthat the notional income of the deceased is to be<\/p>\n<p>taken at Rs.15,000\/&#8211; per annum. on the date of<br \/>\nthe accident, the age of the deceased&#8217;s mother<br \/>\nwas 35 years. On this basis, the ;proper<\/p>\n<p>multiplier is 16. Therefore, the appellahtsW are<\/p>\n<p>entitled for compensation under the head-i\u00a2$sJ\u00a7\u00a3V<\/p>\n<p>dependency as under:\n<\/p>\n<p>Rs.15,000 x 15: Rs 2,4o,0od;w<\/p>\n<p>To this extent, the impugned ra\ufb01ard trequires<\/p>\n<p>modificatien.ui<br \/>\nE3. $he.appel1ants are parents and sisters of<br \/>\nthe deceased, \ufb02owards loss of love and affection,<\/p>\n<p>the; appellants_ are entitled for another sum. of<\/p>\n<p>&#8216;_Rs,15,GO0\u00a7}__ Towards funeral expenses, the<\/p>\n<p>*appeliahts are entitled for Rs.5,000\/~.<\/p>\n<p>,\u00a7;tNFor the reasons stated above, the<\/p>\n<p>l&#8221; following order:\n<\/p>\n<p>The appeal is partly allowed. The impugned<\/p>\n<p>fjudgment and award dated 23.10.2007 in MVC<\/p>\n<p>No.170\/2006 passed by the MACT at Bidar is hereby<\/p>\n<p>modified enhancing the total compensation from<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><br \/>\nRs.1,00,000\/~ to Rs.2,60,000\/-.
