Rathod, Under<br \/>\nSecretary, Legal Department, Sachivalaya, Gandhinagar,  mentioning<br \/>\ntherein the reason for not applying for certified copy in time i.e.,<br \/>\nfor the period between 30\/11\/2005 and 20\/6\/2009. Para. 4 of the<br \/>\nadditional affidavit reads as under :\n<\/p>\n<p> 4.\tI<br \/>\nstate and submit that the explanation from one Mr. C.K. Soni,<br \/>\nconcerned Asstt. Public Prosecutor, Surat, was sought for  who<br \/>\nappeared in the matter and argued the matter on behalf of<br \/>\nprosecution.\n<\/p>\n<p>Paras.\n<\/p>\n<p>6 and 7 of the additional affidavit read as under :\n<\/p>\n<p> 6.\tI<br \/>\nstate and submit that pursuant to this, the concerned Asstt. Public<br \/>\nProsecutor, Surat, Mr. C.K. Soni was asked to clarify the situation<br \/>\nand he vide his communication dated 12\/01\/2010 forwarded affidavit<br \/>\ndated 11\/01\/2010 stating inter-alia that he has not informed the<br \/>\nLegal Department  due to oversight.<br \/>\n[emphasis supplied].\n<\/p>\n<p>7.\tI<br \/>\nstate and submit that the serious note of the said explanation has<br \/>\nalready been taken by the deponent and the deponent has already<br \/>\nproposed to Legal Department to initiate action against the concerned<br \/>\nGovernment Pleader, for showing such gross negligence in performing<br \/>\nhis professional duty.\n<\/p>\n<p>The<br \/>\ndeponent of this additional affidavit has further stated in para. 9<br \/>\nas under :\n<\/p>\n<p> 9.\tI<br \/>\nstate and submit that due to the mistake committed by the concerned<br \/>\nAsstt. Public Prosecutor, the Legal Department was not aware about<br \/>\nthe outcome of the case and therefore no Appeal could be preferred on<br \/>\ntime and  now the<br \/>\nLegal Department has  already<br \/>\nsought to initiate an appropriate proceedings against the erring Law<br \/>\nOfficer.\n<\/p>\n<p>[emphasis supplied].\n<\/p>\n<p>\t\tThe<br \/>\ndeponent i.e. concerned Under Secretary, Legal Department shall place<br \/>\non record the outcome of the proceedings initiated against the erring<br \/>\nLaw Officer.\n<\/p>\n<p>\t\tThe<br \/>\ncontents of the additional affidavit and the proposed action in the<br \/>\nmatter are taken note of.
