Justice ANTONY DOMINIC\n\n Dated :05\/01\/2011\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                   W.P.(C) No. 170 of 2011 U\n             ```````````````````````````````````````````````````````\n            Dated this the 5th day of January, 2011\n\n                            J U D G M E N T\n<\/pre>\n<p>            Petitioner claims to be the owner of 4.45 Ares of<\/p>\n<p>land in survey Nos.22\/18A and 22\/15B of Kullckal village,<\/p>\n<p>Alappuzha. His grievance is that the respondents refused to<\/p>\n<p>accept tax in respect of his property on the ground that the<\/p>\n<p>recovery proceedings at the instance of the fourth respondent<\/p>\n<p>are pending against him.\n<\/p>\n<p>      2.    Even it is accepted that the proceedings under the<\/p>\n<p>Revenue Recovery Act was pending, still being the owner of<\/p>\n<p>the property, in whose favour the land is mutated, the<\/p>\n<p>petitioner is entitled to pay tax and if such amount is paid, the<\/p>\n<p>respondents are liable to accept it.\n<\/p>\n<p>      3.
