Secy.,Vocational &amp; Technical\nEducation &amp;\nPetitioner Counsel :- Ramesh Pandey,Abhishek Dwivedi\nRespondent Counsel :- C.S.C.\n\nHon'ble Devendra Kumar Arora,J.\n<\/pre>\n<p>By means of this writ petition, the petitioner has challenged<br \/>\nthe impugned order dated 17.5.2010, passed by Director,<br \/>\nTraining &amp; Employment, Lucknow whereby petitioner&#8217;s<br \/>\nrepresentation regarding regularisation of his services on the<br \/>\npost of Instructor has been rejected. The petitioner has also<br \/>\nchallenged the consequential order dated 11.6.2010, passed<br \/>\nby Principal, Industrial Training Institute, Etawah by which<br \/>\nrecovery from his salary is sought to be made.<br \/>\nSubmission of learned counsel for petitioner is that the<br \/>\npetitioner was initially appointed as Instructor on 12.8.1980<br \/>\non ad hoc basis. In the year 1983 certain persons junior to<br \/>\npetitioner were regularised. On 3.3.1993, petitioner was<br \/>\ngranted    selection    grade    w.e.f.   18.9.1990.     However,<br \/>\npetitioner&#8217;s case for regularisation remained pending despite<br \/>\ngrant of selection grade. The petitioner represented his case<br \/>\nfor regularisation by submitting his representation dated<br \/>\n04.1.2000, 31.8.2002 and on 19.12.2005 but no heed was<br \/>\npaid. However, during pendency of matter of regularisation<br \/>\nof services, the petitioner was also granted two promotional<br \/>\npay-scales vide order dated 21.4.2008 and 23.10.2008.<br \/>\nPetitioner again represented his case for regularisation on<br \/>\n 22.3.2009. However, under orders of Finance Controller,<br \/>\nDirectorate of Training &amp; Employment, U. P., Lucknow, the<br \/>\nJoint Director, Training\/Apprentices vide order dated<br \/>\n08.9.2009 and 16.9.2009 cancelled the orders whereby<br \/>\npromotional pay-scales were granted to the petitioner. Being<br \/>\naggrieved, petitioner moved representation dated 12.10.2009<br \/>\nand when nothing was done, he filed Writ Petition No. 6813<br \/>\n(SS) of 2009 before this Court seeking directions for<br \/>\nregularisation of his services on the post of Instructor and for<br \/>\ngrant of all consequential benefits. This Court by means of<br \/>\norder dated 28.10.2009 while disposing of the writ petition<br \/>\ndirected the Director, Training and Employment, U. P.,<br \/>\nLucknow to consider and decide petitioner&#8217;s representation in<br \/>\naccordance with law by speaking and reasoned order by<br \/>\ngiving weightage to the recommendations of the Principal,<br \/>\nGovt. Industrial Training Institute, Etawah. Till the disposal<br \/>\nof the representation of the petitioner, the impugned orders<br \/>\ndated 08.9.2009, 16.9.2009 and 24.9.2009 were directed to be<br \/>\nkept in abeyance.\n<\/p>\n<p>The opposite parties in compliance of the order dated<br \/>\n28.10.2009 rejected the petitioner&#8217;s representation for<br \/>\nregularisation of the services of petitioner on the ground that<br \/>\nat the time of initial appointment of petitioner on the post of<br \/>\nInstructor, he did not possess three years&#8217; experience.<br \/>\nSubmission of learned counsel for petitioner is that more than<br \/>\nthirty years have passed in service but the petitioner is still<br \/>\nbeing treated as ad hoc and now an objection has been raised<br \/>\nregarding possessing three years&#8217; experience at the time of his<br \/>\n initial appointment and in pursuance of the same direction has<br \/>\nbeen issued vide order dated 11.6.2010 for making recovery<br \/>\nof excess salary paid to the petitioner after grant of selection<br \/>\ngrade and two promotional pay-scales.\n<\/p>\n<p>Learned counsel for the petitioner has placed reliance upon<br \/>\ndecisions reported in (2004) 1 UPLBEC 127, <a href=\"\/doc\/377154\/\">State of U.P.<br \/>\n&amp; others vs. State Public Services Tribunal, U.P.,<br \/>\nLucknow and<\/a> another, 2008 (26) LC D 1343, Sahab Saran<br \/>\nvs. State of U.P. &amp; others and 1995 Supp (1) SCC 18,<br \/>\n<a href=\"\/doc\/554818\/\">Sahib Ram vs. State of Haryana &amp; others<\/a> in which it has<br \/>\nbeen held that in case the higher pay scale is paid to the<br \/>\ngovernment employee on no fault on his part, the<br \/>\nGovernment shall not be entitled to recover the amount paid<br \/>\nto the employee.\n<\/p>\n<p>The opposite parties may file counter affidavit within four<br \/>\nweeks. Rejoinder Affidavit, if any, may be filed within a<br \/>\nweek thereafter.
