Petitioner is aggrieved by the office order<\/p>\n<p>                   no.40 bearing Memo No.239 dated 17.10.2006,<\/p>\n<p>                   Annexure-3 whereunder the Superintending Engineer,<\/p>\n<p>                   Mechanical Circle, Road Construction Department,<\/p>\n<p>                   Patna has cancelled the promotion granted to the<\/p>\n<p>                   petitioner on the post of Junior Mechanic Grade II and<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>allowed him first, second time bound promotion with<\/p>\n<p>effect from 1.4.1981, 21.03.1991 respectively in the<\/p>\n<p>scale admissible to Mechanic Helper on the ground that<\/p>\n<p>promotion of the petitioner on the post of Junior<\/p>\n<p>Mechanic Grade II was made while he remained in the<\/p>\n<p>work charge establishment and no promotion is<\/p>\n<p>permissible to the employee, who remains in the work<\/p>\n<p>charge establishment.\n<\/p>\n<p>          3. Counsel for the petitioner submitted that<\/p>\n<p>the very foundation of the order dated 17.10.2006,<\/p>\n<p>Annexure-3 that promotion of the petitioner on the post<\/p>\n<p>of Junior Mechanic Grade II was allowed when he was<\/p>\n<p>in the work charge establishment is incorrect. In this<\/p>\n<p>connection, it is pointed out that petitioner along with<\/p>\n<p>others was regularized in the regular establishment on<\/p>\n<p>the post of Mechanic Helper under order bearing<\/p>\n<p>Memo No.1276 dated 4.5.1979 with effect from<\/p>\n<p>1.10.1978, Annexure-1. After regularization of the<\/p>\n<p>petitioner in the regular establishment on the post of<\/p>\n<p>Mechanic Helper with effect from 1.10.1978 his case<\/p>\n<p>was considered for grant of promotion as Junior<\/p>\n<p>Mechanic Grade II under office order no.296 dated<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>          8.9.1979 bearing Memo No.2413 dated 8.9.1979,<\/p>\n<p>          Annexure-2 and petitioner along with others was<\/p>\n<p>          allowed promotion as Junior Mechanic Grade-II with<\/p>\n<p>          effect from 1.10.1979. It is thus evident that petitioner<\/p>\n<p>          was allowed promotion as Junior Mechanic Grade II<\/p>\n<p>          under Memo No.2413 dated 8.9.1979 with effect from<\/p>\n<p>          1.10.1979 after he was already regularized in the<\/p>\n<p>          regular establishment under order dated 4.5.1979 with<\/p>\n<p>          effect from 1.10.1978. In the circumstances, impugned<\/p>\n<p>          order dated 17.10.2006 Annexure-3 cancelling the<\/p>\n<p>          promotion of the petitioner suffers from the vice of<\/p>\n<p>          arbitrariness and is, accordingly, quashed. Petitioner<\/p>\n<p>          having superannuated during the pendency of the writ<\/p>\n<p>          petition i.e. 30.09.2007, the Superintending Engineer is<\/p>\n<p>          directed to ensure payment of the retiral dues treating<\/p>\n<p>          the petitioner to have superannuated on the post of<\/p>\n<p>          Junior Mechanic, Grade-II after granting him all<\/p>\n<p>          consequential relief.\n<\/p>\n<p>                    4. The writ application is, accordingly,<\/p>\n<p>          disposed of.\n<\/p>\n<\/p>\n<p>                                  ( V. N.
