Justice K.R.UDAYABHANU\n\n Dated :15\/02\/2007\n\n O R D E R\n                          K.R.UDAYABHANU, J\n\n                      ---------------------------------------------\n\n                        CRL.R.P.No.4415 of 2006\n\n                      ---------------------------------------------\n\n             Dated this the 15th day of February, 2007\n\n\n\n\n\n\n                                       ORDER\n<\/pre>\n<p>      Revision   petitioner   stands   convicted  for   the   offence   under<\/p>\n<p>Section 138 of the Negotiable Instruments Act and sentenced, as<\/p>\n<p>modified by the Sessions Judge to pay an amount of Rs.3,00,000\/-<\/p>\n<p>as   compensation   to   the   complainant   under   Section   357(3)   of<\/p>\n<p>Criminal   Procedure   Code   and   in   default,   to   undergo   simple<\/p>\n<p>imprisonment for four months.\n<\/p>\n<\/p>\n<p>      2.     The   learned   counsel   for   the   revision   petitioner   has<\/p>\n<p>only   sought   for   modification   of   the   sentence  to   undergo  simple<\/p>\n<p>imprisonment   for   a   period   of   three   months.                   In   the<\/p>\n<p>circumstances, sentence is modified imprisonment till the rising<\/p>\n<p>of the court and to make payment of compensation as ordered by<\/p>\n<p>the   courts   below.     Considering   the   plea   of   the   counsel   for   the<\/p>\n<p>revision   petitioner,   the   revision   petitioner   is   granted   three<\/p>\n<p>months&#8217;   time   to   pay   the   amount   of   compensation   to   the<\/p>\n<p>complainant.     Revision   petitioner   shall   appear   before   Judicial<\/p>\n<p>CRRP4415\/2006                Page numbers<\/p>\n<p>First Class Magistrate Court &#8211; Koyilandy on 16.5.2007 to receive<\/p>\n<p>the sentence.
