Sahabuddin\n                                             Versus\n                                       The State Of Bihar\n                                             -----------\n<\/pre>\n<p>03\/   19.09.2011          Power is filed on behalf of the informant.<\/p>\n<p>                              Heard learned counsel for the petitioner as well as learned<\/p>\n<p>                   Addl. Public Prosecutor for the State assisted by learned counsel for<\/p>\n<p>                   the informant.\n<\/p>\n<p>                              Petitioner is in jail custody since 7.4.2011 in a case<\/p>\n<p>                   registered under sections 363, 342, 328, 376(2)(G), 307\/120B of the<\/p>\n<p>                   IPC.\n<\/p>\n<p>                              It is the specific case of the informant that his daughter aged<\/p>\n<p>                   about 12 years was taken away and subsequently, the petitioner and<\/p>\n<p>                   other FIR named accused persons committed gang rape on her.<\/p>\n<p>                              Learned counsel for the petitioner points out that no sign of<\/p>\n<p>                   injury was found in medical examination of the victim and<\/p>\n<p>                   furthermore, victim was examined under section 164 of the Cr.P.C,<\/p>\n<p>                   she has not named the petitioner in the said statement. It is also<\/p>\n<p>                   pointed out by him that, as a matter of fact, this false case has been<\/p>\n<p>                   brought by the informant on account of land dispute with his step-<\/p>\n<p>                   brother.\n<\/p>\n<p>                              Learned counsel for the informant points out that the<\/p>\n<p>                   petitioner was put on test identification parade and victim claimed to<\/p>\n<p>                   identify the petitioner in the above stated test identification parade.<\/p>\n<p>                              Taking into consideration the above stated facts and<\/p>\n<p>                   circumstances as well as submissions of the parties, I am not inclined<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>         to release the petitioner on bail.\n<\/p>\n<p>                    Accordingly, prayer for bail of the petitioner in connection<\/p>\n<p>         with Kotwali P.S.
