Justice K.HEMA\n\n Dated :12\/01\/2009\n\n O R D E R\n                            K.HEMA, J.\n                     ------------------------------\n                     B.A. No.6916 OF 2008\n                     ------------------------------\n            Dated this the 12th day of January, 2009\n\n\n                             O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 448 and 171-<\/p>\n<p>C of IPC and Section 3(1) of Prevention of Damage to Public<\/p>\n<p>Property Act. According to prosecution, Form 6B register and<\/p>\n<p>ballot papers were destroyed by petitioners and others.<\/p>\n<p>Petitioners are accused nos.1 to 5.\n<\/p>\n<p>      3. Learned counsel for petitioners submitted that the<\/p>\n<p>allegations made against petitioners are absolutely false. A<\/p>\n<p>writ petition was filed by fourth petitioner and another<\/p>\n<p>accused before another bench of this court and as per order<\/p>\n<p>dated 28.10.2008 vide Annexure IV, the disputes between the<\/p>\n<p>parties were looked into and the order will show that there<\/p>\n<p>was no allegation that Form 6B register was destroyed by<\/p>\n<p>petitioners or any other person. Therefore, this is a false case,<\/p>\n<p>which was fabricated after disposal of the writ petition,<\/p>\n<p>alleging that petitioners and others committed the offences on<\/p>\n<p>22.10.2008, prior to the disposal of the writ petition. It is also<\/p>\n<p>B.A.No.6916 of 2008<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>submitted that in the F.I. Statement, names of the petitioners<\/p>\n<p>were not mentioned. But it is only alleged that a &#8220;group of<\/p>\n<p>persons&#8221; committed the offences.\n<\/p>\n<p>       4. This petition is strongly opposed. Learned Public<\/p>\n<p>Prosecutor submitted that there is clear evidence to show that<\/p>\n<p>petitioners committed various offences on 22.10.2008. The fact<\/p>\n<p>whether the register was destroyed or not, was not a matter of<\/p>\n<p>consideration in the writ petition. Only because of the omission<\/p>\n<p>in the order in writ petition, as pointed out by learned counsel<\/p>\n<p>for petitioner, it may not be proper to come to a conclusion<\/p>\n<p>that no offence was committed, as alleged by petitioners. It is<\/p>\n<p>submitted that the register was taken into custody by the<\/p>\n<p>police on 22.10.2008 itself, and the mahazar was also prepared<\/p>\n<p>showing that the pages were torn off. Therefore, there is no<\/p>\n<p>substance in the arguments advanced by the defence, it is<\/p>\n<p>submitted.\n<\/p>\n<p>       5. Learned Public Prosecutor submitted that during<\/p>\n<p>investigation, it is revealed from statement of various<\/p>\n<p>witnesses that petitioners are the persons involved in the<\/p>\n<p>offence along with others. It is also pointed out that statement<\/p>\n<p>B.A.No.6916 of 2008<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>of witnesses are available in the case diary to clearly implicate<\/p>\n<p>petitioners in the offence.\n<\/p>\n<p>       On hearing both sides and on considering the nature of<\/p>\n<p>the allegations made, I am satisfied that it is not a fit case to<\/p>\n<p>grant anticipatory bail. I am not inclined to invoke provisions<\/p>\n<p>under section 438 Cr.P.C.\n<\/p>\n<p>       The incident occurred as early as on 22.10.2008 and<\/p>\n<p>petitioners have not surrendered so far either before the<\/p>\n<p>Magistrate court or before the police.\n<\/p>\n<p>        Petitioners are directed to surrender before the<\/p>\n<p>        Magistrate court concerned or the Investigating<\/p>\n<p>        Officer and co-operate with the investigation.<\/p>\n<p>        Whether they surrender or not, police is at liberty<\/p>\n<p>        to arrest them and proceed in accordance with law.<\/p>\n<p>       With this direction, the petition is dismissed.<\/p>\n<p>                                               K.HEMA, JUDGE<br \/>\npac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Lissy Joseph vs State Of Kerala on 12 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6916 of 2008() 1.
