Chemicals, learned advocate Mr. MS Mansuri appearing on<br \/>\n\tbehalf of respondent workman.\n<\/p>\n<p>In<br \/>\n\tpresent petition, petitioner establishment has challenged order<br \/>\n\tpassed by Industrial Tribunal, Baroda which is at page 13 below exh<br \/>\n\t95 dated 16\/12\/2009.  The application was preferred by petitioner<br \/>\n\twith a prayer to first decide reference no. 102\/96 and till date<br \/>\n\tcomplaint filed by workman not to be decided and stayed proceeding<br \/>\n\tof complaint.\n<\/p>\n<p>This<br \/>\n\tapplication has been examined by Industrial Tribunal which has been<br \/>\n\traised by petitioner Company as preliminary point before Industrial<br \/>\n\tTribunal, Baroda.  The said application made by petitioner exh 95<br \/>\n\thas been rejected, against which, present petition is filed by<br \/>\n\tpetitioner.\n<\/p>\n<p>This<br \/>\n\tCourt has issued notice to respondent. Meanwhile, directed to<br \/>\n\tmaintain status quo which has been objected by other side.<br \/>\n\tTherefore, status quo as on date 1\/2\/2010 maintained till date.\n<\/p>\n<p>I<br \/>\n\thave considered submission made by both learned advocates.  The<br \/>\n\tquestion involved in complaint filed by workman as well as in<br \/>\n\treference no. 102\/96 are almost same and identical required to be<br \/>\n\tdecided by Industrial Tribunal, Baroda together.  The difficulty is<br \/>\n\tthat record and proceeding of reference no. 102\/96 has been called<br \/>\n\tfor by this Court in SCA no. 18766\/2005, where this Court has passed<br \/>\n\tfollowing order on 13\/7\/2006, is as under:\n<\/p>\n<p> Heard<br \/>\nthe learned advocate Mrs.Sangeeta Pahwa on behalf of the petitioner.<br \/>\nLearned advocate Mr.Gandhi appearing on behalf of<br \/>\nrespondent-establishment.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mrs.Sangeeta Pahwa submitted that present petitioner is not<br \/>\nsurplus employee, which require to be retrenched by the respondent,<br \/>\nbut he was remained in service through out from 1988 to 1993. This<br \/>\nquestion has been decided by  Industrial Tribunal against petitioner,<br \/>\nwhich has been challenged in the present petition. The question of<br \/>\nsurplus is to be examined on the basis of the fact that at the time<br \/>\nof filing permission of closure application before the Appropriate<br \/>\nAuthority and subsequent to his decision, reference has been made in<br \/>\nreference I.T. No.179\/88, Industrial Tribunal, Ahmadabad.\n<\/p>\n<p>\tIn<br \/>\nlight of these facts, which are on record, this Court having opinion<br \/>\nthat entire papers of reference I.T. No.179\/88 in respect to Sarabhai<br \/>\nM.Chemicals is necessary to be taken into account to examine the<br \/>\nquestion raised in the present petition. Therefore, it is directed to<br \/>\nthe Registrar, Industrial Court, State of Gujart, Ahmedabad to send<br \/>\noriginal record and proceedings of reference I.T.No.179\/88 in respect<br \/>\nto Sarabhai M.Chemicals to this Court immediately or or before 3rd<br \/>\nAugust, 2006. Registry is directed to serve immediately, the order of<br \/>\nthis Court to the Registrar, Industrial Court, Ahmadabad. Over and<br \/>\nabove direct service is permitted.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid order passed by this Court, at present original<br \/>\n\trecord and proceeding of reference IT no. 179\/88 new no. 102\/96 are<br \/>\n\tlying with registry of this Court i.e. how hearing of complaint<br \/>\n\tfiled by workman and dispute raised by Union in respect to reference<br \/>\n\tno. 102\/96 are remained pending and not decided which required to be<br \/>\n\tdecided together.\n<\/p>\n<p>Therefore,<br \/>\n\tRegistry is directed to sent original record and proceeding of<br \/>\n\treference IT no. 179\/88 new no. 102\/96 in respect to Sarabhai M.<br \/>\n\tChemicals immediately to Industrial Tribunal, Baroda.  So, it will<br \/>\n\treach to Industrial Tribunal, Baroda on or before 30\/4\/2010.\n<\/p>\n<p>After<br \/>\n\treceiving original record and proceeding of reference IT no. 179\/88<br \/>\n\tnew 102\/96, it is directed to Industrial Tribunal, Baroda to decide<br \/>\n\tcomplaint filed by workman as well as present reference no. 102\/96<br \/>\n\ttogether.  This has to be decided by one Industrial Tribunal,<br \/>\n\twherein reference no. 102\/96 is pending.  It is directed to concern<br \/>\n\tparties to co-operate hearing before Industrial Tribunal, Baroda in<br \/>\n\trespect to complaint and present reference filed by workman.  Let<br \/>\n\tIndustrial Tribunal, Baroda decided both together as early as<br \/>\n\tpossible preferably before 31\/12\/2010.\n<\/p>\n<p>In<br \/>\n\tview of above observation and direction, present petition is<br \/>\n\tdisposed of by this Court without expressing any opinion on merits.<br \/>\n\tIt is made clear that original record and proceeding which has been<br \/>\n\tcalled by this Court in SCA no. 18766\/2005 by order dated 13\/7\/2006<br \/>\n\tis kept open by this Court that as and when petitioner would require<br \/>\n\toriginal record and proceeding, then such request can be made by<br \/>\n\tpetitioner before this Court.  At that occasion, this Court will<br \/>\n\tconsider request which will be made by petitioner.
