When the matter was heard on 10.07.2008, this Court had put<br \/>\nforward a suggestion to learned advocate for the applicant that this<br \/>\ncourt is prepared to fix the second appeal for final hearing in view<br \/>\nof the fact that the original petition filed by the<br \/>\nrespondent-husband was dismissed but the appeal was allowed  and that<br \/>\nthe Marriage Petition is of the year 1999.  The Civil Appeal has been<br \/>\npreferred in the year 2003.  However, the said proposition was not<br \/>\naccepted and it seems that the applicant is not willing to proceed<br \/>\nwith the final hearing.\n<\/p>\n<p>2.\tEven<br \/>\ntoday when the same proposition was  put forward to the applicant, it<br \/>\nis borne out that the applicant is not ready to proceed with the<br \/>\nfinal hearing.  Therefore, it is quite clear that the applicant is<br \/>\ntaking undue advantage of the court proceedings which have been and<br \/>\nmay prolong for a considerable period of time.  In that view of the<br \/>\nmatter, prima facie this application does not prove to be a bonafide<br \/>\none.\n<\/p>\n<p>3.\tHowever,<br \/>\nthe main prayers being prayers in terms of para 10 urged in the<br \/>\npresent application are as under:\n<\/p>\n<p>(A)<br \/>\nto pass an order upon the respondent husband to pay all the arrear<br \/>\namount of interim alimony as per Exhibit 139 in Regular Civil Appeal<br \/>\nNo. 42 of 2003.\n<\/p>\n<p>(B)<br \/>\nto pass an order directing the respondent husband to pay permanent<br \/>\nalimony as per the Exhibit No. 97 which has not been taken into<br \/>\nconsideration while passing order in Regular Civil Appeal No. 42 of<br \/>\n2003 for granting permanent alimony.\n<\/p>\n<p>4.\tThe<br \/>\napplicant has also prayed for grant of interim relief by way of<br \/>\npassing an order to the respondent husband to pay interim alimony @<br \/>\nRs. 15000\/- per month.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned counsel for the parties.  As a result of hearing and perusal<br \/>\nof the records, this Court is of the view that as far as the main<br \/>\nprayers are concerned, it would be in the interest of justice to hear<br \/>\nthis application and the application for stay alongwith the main<br \/>\nmatter.  As far as the interim prayer is concerned, the same is<br \/>\nunreasonable in view of the fact that an alimony of Rs. 5500\/- is<br \/>\nalready being paid to the applicant which is sufficient to sustain.<br \/>\nThis application qua interim relief is hereby rejected.\n<\/p>\n<p>6.\tIt<br \/>\ncannot go without saying that the conduct of the applicant of not<br \/>\nconducting the hearing is plainly to take advantage of the long time<br \/>\npendency of this matter before this court and such an attitude cannot<br \/>\nbe allowed to be adopted by any party to the proceeding before this<br \/>\nCourt.  In that view of the matter, it will be open to the parties to<br \/>\nmove for early hearing.\n<\/p>\n<p>7.\tAs<br \/>\nfar as the prayers in terms of para 10 are concerned, the same are<br \/>\nnot taken up for hearing today.  The hearing for the prayers made in<br \/>\npara 10 shall be done alongwith the second appeal.
